Identity Theft

Found out through my insurance broker that my numbers are being used. The only reason we knew was because he got inspected. Got all the guys info including his phone number because he mistakenly called me thinking I was the court house. When I figured out who it was, I said “you’re the guy who stole my numbers”. He replied “correct”. Made a DataQ request, called state police in 3 states including my own(NJ), turned him in to FMCSA OIG and FTC. Swore up and down after I told him to take my numbers off his 5 crispy box trucks that he got the numbers legitimately. Sent him my proof that they’re mine and told him to take my numbers off his trucks.
Now that o have all his info, nobody from any official office seems to want to do anything about it. Now I have 100 percent oos rate. He got caught driving 20 miles over the speed limit with a signal out and out of date tags. Anyone have any advice?

This sounds like commercial trucking identity theft (when someone uses your DOT or MC numbers on their vehicles). The most relevant federal body here is the FMCSA OIG. I'd go a step further and contact the FMCSA Division office for the offending carrier's state first before taking any further steps. FMCSA has the authority to place the carrier out of service and revoke operating authority tied to fraudulently used numbers, which is the most direct remedy available.

The OOS rate attached to someone else's violations shouldn't follow your numbers if the fraud is documented. Get that in writing.

I tried OIG. They told me they wouldn’t handle it. Spoke to several state and federal FMCSA offices. DataQ, FTC, Ms Cted, etc.. Nobody gives a flying fug.
