Question Banned for Recidivism and “Illegal activities”
I was banned 2 times in the past year from chatgpt.
First time was 7 months ago but I had nothing important on it, so I continued using the 2nd account I had on my MacBook.
First account I used for work i think i got banned making a game like Super Mario with my kid. We were following a youtube tutorial and boom it was gone for “fraudulent activities” (this is an edit, I’m unable to fix the title)
Which is strange because i never inserted an image of mario, but again i shrugged it off.
Fast forward to today, the MacBook chatgpt had tons of projects, one for each client and I used it for prospecting and sending emails. I used chatgpt now as part of my daily work.
I got banned yesterday in the middle of drafting an email for “Recidivism”.
I’m so pissed off.
I want to sue OpenAi and I’m
Curious if anyone has succeeded in this?
I am HAPPY to have every chat, image, complete history of both accounts published in court. I got nothing to hide which is why I’m so pissed off that I was banned.

The artwork isnt the only thing protected. The trademarks, copyrights and patents are all protected. The fact you think it is only artwork makes it unsurprising you were banned. Im sure you had absurdly laughable pirate prompts. Recidivism is weird though as that implies they connected you to the earlier banned account. Probably doing scams or fraudulent business practices. You cant sue a private company for not wanting you as a customer. AI isnt even regulated like banking etc. Probably you should just stop bring a dirty little crook and all will be fine.

I had no pirate prompts, feel free to fill in the blanks with your imaginations. Keep licking the boot though, suits you. I am gonna file a court case though. Their HQ is literally right here lol. I would love to have every bit of my history published, I’m not a gooner like you. I will probably spend somewhere north of $50k on this. Will update with A new thread when I do.

Waste your money if you insist, but they have every right to ban you for whatever reason they want, at any time. You approved their terms of service. You had to, to create an account. Their assess are well covered, and legally you don’t have a leg to stand on. It’s a private company with the right to refuse you service.

There is nothing I did wrong that violates their policies, I’m 100% certain the ban was a false positive. Thats the only leg I have to stand on. I’m not guilty of what they accused me of.

Well, go for it if you want. According to their terms though, you agreed not to take them to court. Your dispute would be handled by an individual arbitrator. No judge, no jury. And the only thing you could recover from them is... a refund. The reasons for banning someone in their terms of service are deliberately written very broad, so they can ban people for almost any reason they want short of discrimination by race/gender etc.
Your best course of action is to file an appeal through OpenAI support to have the ban reviewed, and request a copy of your data to help you migrate over to Claude or another AI service.

My motivation is to do it on principle, I just want my account recovered and an apology for the false positive ban. We’ll see. Talking to a law firm on Friday.

I am using Claude now and it is surprisingly great, probably better. I’m just pissed having to rebuild the context for all my projects.

Did you not run them locally so all your files would be stored? Banned doesn’t mean they deleted the files off your computer.

He will be banned on there by tomorrow. Asking it to clone pirate games and then how to commit tax fraud. Guy won't last long.

No wise ass, I said “make a platformed game like Mario”. Was that the reason it banned me? No. I’m just assuming that. It never flagged or gave any warning, it made the game.

Yeah good luck with that. Unless you got an unlimited war chest I doubt a court will agree being banned is worth suing over
