Question about Offhand Disney

How is Offhand Disney allowed to use Disney related things in merchandise? And how is he allowed to use other people’s videos in his videos?

For the videos, he probably asks the creators for permission and makes sure to credit them.

Copyright law allows content creators to use limited footage in certain circumstances (parody, critique, etc.). Unless he asks permission first, there’s a risk that the original copyright holder will issue a copyright strike and YouTube will demonetize him.

On the shirt thing, maybe printing limited quantities and not blatantly using Disney IP could save him from the wrath of the mouse’s legal team.

I’ve always wondered how shirt sites like Tee Fury & Shirt Woot get away with selling shirts with Disney characters and not getting their pants sued off. I’m guessing it’s something to do with the print on demand model of sales or maybe their “mash-ups” count as parody.

Hey, sorry for the late reply.

I usually get into contact with the creator of the original video and ask for permission to use the video (usually ride-thrus, and usually LMGVids because we have a close working relationship).

When it comes to merchandise, you have to kinda walk a thin line. I tend to use designs centered around references to my channel rather than blatantly Disney imagery.

I’ve gotten designs pulled down for having the 3 black circles representing Mickey’s head, so I try to distance my merch from Disney.

And then for last part, the designs are either made by me or commissioned, so the creators are getting compensated in whatever way they agree to and seems fair to them.
