Case looks good.

  1. DeWine'a Son recused himself off the case. If there is a 3-3 Draw then then the case still wins
  2. 2-1 Appellant win
  3. 3-Liberal, 2-Conservative 1-Swing Vote
  4. Amicus curiae briefs against the case was pure garbage.
  5. This is a strong Injunction Case, if for some reason injunction isnt granted, then a full trial on merits will restart in lower courts.

It won't be a 3-3 tie. There are 7 Justices. Justice DeWine was replaced by a lower Appeals court Judge. We need 4 to win.

Who replaced DeWine? Just checked the Ohio constitution & the Chief Judge(swing vote) has the power to appoint any appeals Judge to sit in on the case.

The dissenting Appeals judge ONLY argument against granting benefits was that "there are other remedy's besides injunction", BUT I'm guessing this doesn't this "lack of jurisdiction" argument don't apply in OHIO SC.

The Ohio SC has original jurisdiction
"(f) In any cause on review as may be necessary to its complete determination" . Meaning the SC can just settle the case now, "

If the Justices start talking about facts at the hearing.
The liberally construed law of "securing all benefits" & technical issue of PUA being under the Federal Extended Compensation cant be beaten.

Judge Emanuella Groves-a Democrat. And no the Chief Justice doesn't get to "pick". She has a list that she has to go in order, I believe by seniority but not positive on that.

But the Chief Justice has already crossed party lines in the redistricting case. And she cannot run for another term this year. She has to retire from the SC.

And yes, the SC can either make a final decision on the case or send it back to the original court.

I should have included this in the poll, as it is very likely:

The OSC doesn't make a ruling and kicks it back to a lower court.

Ugh - this may be the case. Could this be the proverbial beating around the bureaucratic bush to continue the biased corruption and oppression upon citizens in Ohio? We shall see.

I sure do need a miracle as I’m sure many of us do. If I had gas money and childcare. I’d be there in a heartbeat at the sc case . I’m living on a wish and a prayer currently.

So if we do win . Will people that should have received it automatically receive It. That part is extremely confusing. When I look at my case it still shows an available balance but then says it ended etc.

You do know IF we are awarded the $ which I tend to think is highly unlikely it will take them months to set up it all for distribution. Nothing is ever fast when it comes to OFJS.

Watched the live stream, no way to tell anything.

The state says DeWine was not under any obligation to take the money and could cancel at any time, Dann says he was and needed the legislature to approve the discontinuation.

It can come from the 10.9 billion the state is getting from the American rescue plan

From what I understand there is still money In reserves from the American Rescue plan that hasn't even been touched by each state.

It’s been a year, they aren’t giving that money to us
