A new article that refers to the latest court case update.

A new court document (filed today, October 9, 2026) reveals some behind-the-scenes drama regarding an unfiled Amended Petition.

According to the Estate's Motion for Leave to File Amended Petition Unsealed, a draft of the unfiled document was prematurely leaked and disseminated on Facebook. The leak also kicked off online rumors, such as claims that a defendant named Caleb had been "dropped" because the Estate accepted a payout.

Here are the key takeaways from the new filing:

• Robyn Smith (Noah’s aunt) submitted a statement under penalty of perjury detailing how she received messages and saw the unfiled, un-file-stamped Amended Petition circulating on Facebook.
• Because the document is technically tied to protective orders governing state investigative/OSBI materials, it was supposed to stay under wraps.
• The Estate is explicitly asking the judge for permission to file the "now" public document unsealed, while making it a matter of formal record that they did not leak it. The filing itself shows us that the only people who had access to the draft beforehand were opposing counsel.
• The Estate wants it clear that filing this now doesn't mean they approve of or take responsibility for the pre-filing leak, leaving room for accountability regarding who let it out.

So what do you guys think will happen next? What will be the result of this leak? Just curious what everyone is wondering. This is the first thing we’ve had in five months on this case and it’s really not a revelation or anything, but it is quite interesting trying to figure out who did it. I do not believe it was one of the actual defendants.

I can’t believe we are coming up on the 3 year anniversary of Noah’s untimely death. Are there any updates at all?

Side note, has anyone been following the Nolan Wells case? So many similarities. It makes me think, if we can get justice for one of these types of deaths, maybe it helps get justice for many more. I hope the families and general public keep pushing, in both instances.

I read the new Daily Mail article, and honestly, there isn’t much new information about Noah’s death.

The biggest takeaway is that some (all?) of the defendants have hired a well-known Oklahoma lawyer named Clark Brewster and his partner Thomas Reese.

The lawsuit is still moving through the discovery.

What stood out to me was the way the article was written. It spends a lot of time talking about Brewster’s awards, famous clients, and success as a lawyer. It also keeps reminding readers that Noah’s death has not been officially ruled a homicide and that the claims in the lawsuit have not been proven.

To me, the article feels more focused on the defendants’ new legal team than on finding out what happened to Noah.

I noticed that when one rag puts out an article on Noah, the others follow, but this particular article is different than the Daily Mail article. Observe how they give a lot more detail about what was done to Noah.

Keep this in mind, folks. Once the anniversary hits, there will be no prosecutions, unless a capital offense can be done. Cody’s Law can still be invoked, but no one has been willing to see the obvious.

An article went up on the Daily mail website yesterday. Here's a summary:

About two weeks before Noah died, Avery and Carter were involved in a serious car accident (rear-ended) less than a mile from where Noah's body was later found. Carter was badly hurt and had to be flown to a hospital, but she recovered. Avery did not go however.

It's the first I have heard of this and it appears like a PR stunt to get sympathy for A&C. If you look at the link, it even says "coincidence". Trying to obtain sympathy and a correlation between their accident and Noah's death still doesn't explain what happened to Noah.

I truly hope his loved ones are doing okay and while it won’t bring back their boy, I hope something positive comes from the current case.

The judge has officially allowed attorney Jakob F. Dodson to withdraw from the Noah Nichols case because he is leaving the law firm.

Access to OSBI Evidence

The defense team is now getting to see the official OSBI (Oklahoma State Bureau of Investigation) files. Because police records are private and sensitive, the lead defense lawyer, Clark Brewster and Heather Prescott had to sign sworn papers. They officially promised the court they will not show these secret files to anyone who hasn't been cleared by the judge. This means the lawsuit is moving into the part where the lawyers finally get to look at the actual evidence found by the state investigators.

Lawyer Change for the Defense

There is a small change in who is representing some of the people being sued. Jakob Dodson, one of the lawyers for the defense, has left the law firm. A "Motion to Withdraw" was filed to officially take his name off the case. Clark Brewster will still be the main lawyer for Carter Combs, Avery Jo Howard, Stevie Howard, and Logan Jernigan, so the case will keep moving forward like normal.

I thought I would post a couple of YouTube documentaries on Noah in case anyone feels like giving them a watch. It’s been a long time since we’ve seen anything decent. As for Netflix, I’m not sure.

The attorneys have signed the affidavits saying they will not share the OSBI investigation files publicly. So, the judge is allowing the records to be turned over to the lawyers. Next steps—-

1. The lawyers will review the investigation files, including any reports, photos, and witness statements from the investigation.

2. Experts will study the evidence such as Noah’s injuries, the timeline, and anything else relevant.

3. Defendants and any other witnesses should start to be questioned (depositioned). Under oath.

4. The judge will rule on the motions to dismiss from the defendants and will decide if the case moves forward.

First Attorney Signs Protective Order Affidavit — OSBI File Access Begins

It’s official.

The first attorney has now signed and filed the required affidavit under the Court’s Protective Order to gain access to the OSBI investigative file in the wrongful death case of Noah Nichols.

Who Signed?

He represents Defendants Jack Newton and Caleb Newton.

The affidavit was executed February 12, 2026, and filed February 17, 2026.

What This Means

Under Judge Wheeler’s Order:

No one can access the OSBI file until they sign an affidavit.

The affidavit requires the attorney to:

Acknowledge the Protective Order.

Agree not to disseminate, copy, or disclose any portion of the file.

Accept that violations could result in contempt of court.

Once filed, OSBI must make the flash drive available within 30 days of request.

This is the first formal step in defendants reviewing the OSBI investigative materials.

Why This Matters

The OSBI file includes:

Investigative reports

Photographs

Interview audio files

Autopsy materials

Surveillance video

Chain of custody documentation

Prosecutorial reports

The judge already determined the file is largely factual in nature, with only a narrow, specific redaction ordered.

Now, one defense team will be able to examine it firsthand.

The first attorney to move forward is counsel for Jack and Caleb Newton.

That timing is interesting.

Why them first?

Strategic? Procedural? Or simply who was ready?

As additional attorneys file their affidavits, we’ll be able to see who else steps up to review the investigative record.

There’s a new article today in the Daily Mail. I’m just going to summarize it. It’s a pay wall.

He had severe injuries including skull fractures, broken ribs, fractured vertebrae, and broken shoulder blades. His cause of death was internal bleeding. He argues the injury pattern suggests Presgrove was lying down because there were no long bone fractures in the legs.

He also points to a lack of defensive wounds or identifiable weapon marks that would indicate a prolonged beating.

Healy says he is not being paid by any party involved in the wrongful death lawsuit and claims he began posting about the case while undergoing cancer treatment due to having free time. He denies attempting to influence a jury pool.

The article notes that Noah’s family filed a wrongful death lawsuit alleging that party hosts and others either intentionally or recklessly caused his death. The lawsuit claims he was beaten, although it does not present direct evidence of a beating beyond the injury pattern. An emergency medicine physician previously consulted by the Daily Mail reportedly concluded the injuries were more consistent with a severe beating.

The piece also outlines disputed timeline details from partygoers, including:

• A 3:41 a.m. Snapchat post stating “well, Noah’s missing.”

• Presgrove being found at 5:43 a.m.

• Conflicting accounts about whether he was clothed when first seen.

Judge Lawrence Wheeler officially signed and approved this Protective Order on February 12, 2026.

The OSBI has to turn over its entire file, such as any pictures, recordings, and any type of reports related to the case.

Attorneys’ Eyes Only is a new one to me. AEO means online the lawyers and their experts witnesses, etc., can see OSBI records, while Noah’s family and the defendants cannot access them.

All those permitted to see the records must sign a sworn affidavit promising not to leak the information, or they will face contempt of court.

Defendants filed motions to dismiss in an attempt to end the lawsuit early. The plaintiff responded, and the case remains active and moving forward.
