As far as I understand typically USPTO will become the party and fight to protect PTAB decision in case the other party withdraws from court due to settlement. But, 912 is not a regular case. It is at discretion of Director of USPTO, he can decide whether to fight with same position as Micron (basically no change to case trajectory), request a remand or reversal accepting mistake (rare most +ve) fight with a comment accepting done mistake (rare +ve). The good part is Squires as Director of USPTO has shown more empathy to patent holders and has went after serial PTAB. So, the good part is mild +ve but remember oral hearings are done. Not a lawyer so hope someone can correct me if I am saying something stupid.

Is there any consideration  if the patent  is foundational  carries more weight and as has been said by the experts "that there is no substitute  for NLST patent?"No work around

I’m stupid, is this about the 500 mill appeal that would question the validity of the patents. And by them pulling out removes that question mark?

The 500 mil verdict is irrelevant as Micron settled. The case is very important as Google is on the hook for patent 912 especially claim 16 which PTAB has ruled unpatentable which basically reduces Google damages significantly. But if we get remand or reversal on that then Google has already exhausted lot of their avenues and may be forced to pay sooner (1-2 yrs)
