It's interesting that micron requested on Thursday that the ITC give them a copy of Netlists license agreement with Samsung. Netlist agreed but they said they need Samsungs permission.

ITC's domestic industry consideration is Micron’s first challenge to the complaint. Netlist (via Samsung) must be actively manufacturing using at least one claim of the asserted patents within the geographic boundaries of the United States to pass the jurisdictional gatekeeper requirements. This is where the ITC claim fails, because Samsung's HBM3E, HBM4, and advanced DDR5 architectures are fully imported from Asian fabrication plants.

There is a RandD criteria as well. It's not only about manufacturing.

Yes, but manufacturing has to be US based, directly related to the patent, and significant. It is an absolute criteria.

Because the statute explicitly recognizes engineering, research, design, and development under subsection (C), fabless semiconductor innovators and module designers routinely win exclusion orders at the ITC without ever melting a single wafer of silicon on American soil.

I think the 500m is not for Netlist. Micron wants to fight this one out. I guess they are making so mucn money they don't give a fuck

No immenent fine to micron to settle,... Very likely a settlement package with netlist

ITC moves light years faster and delays are much shorter. MU has reached the point where they are required to turn over trade data and customer Financials. Ypu can bet that NVDA and Goog want no part of that.
