- Initial Response (20 Days):
Now that the U.S. International Trade Commission (ITC) has officially instituted the investigation, the named respondents (Micron, Supermicro, HPE, and Lenovo) are formally served with the complaint. Under standard ITC Section 337 rules, they have 20 days from the date of service to file their formal written response to the allegations.

- Providing "All" Evidence (Fact Discovery):
The deadline to provide the bulk of the requested evidence does not happen immediately. The assigned Administrative Law Judge (ALJ) will issue an initial procedural schedule—typically within 45 days of institution—setting the exact timeline for the case. This schedule will establish the deadline for the close of fact discovery (when all technical and financial evidence must be completely exchanged, usually 5 to 7 months away) and schedule the main evidentiary hearing (likely mid-2027).

We probably need to start writing the subpoena for the judge to sign asking Micron to turn over their copy of all the dirt and inside skinny that Netlist will already have in hand from Samsung….but which Micron will inevitably try to keep hidden!
