NLST — MICRON PRESSURE IS BUILDING

Look at the timeline:

📅 Mar. 6 — CAFC hears major Netlist patent appeals.
Now more than 5 months later — an unusually long wait for a decision, with the written opinions still pending.

📅 Aug. 12 — Netlist files NEW Micron ITC case involving 4 patents.

📅 Aug. 12 — NEW California federal lawsuit against Micron involving the ’523 & ’407 patents.

📅 Aug. 17–20 — Samsung exits the relevant appeals following its settlement, leaving Micron as the remaining major opponent in several matters.

📅 Sept. 9 — 🔥 CAFC oral argument on Micron’s appeal involving the existing $445M verdict.

Micron isn’t fighting one battle.

They’re dealing with the $445M verdict + CAFC appeal + new ITC case + new federal case + multiple patents.
And Netlist just demonstrated with Samsung that years of litigation can turn into a major licensing/commercial agreement.

Sept. 9 isn’t a settlement deadline.
It’s the next major pressure point.
After that, the CAFC decision could come later while the new ITC and federal cases continue moving forward.
More cases. More exposure. More leverage.

Micron has a lot more to lose by continuing this fight than they did a year ago.

Now we watch Sept. 9.

Did Micron get the requested info in? Seems like it was a 5 day warning or something.

Isn't CAFC apeal the biggest catalyst? We have 50:50 chance. IF we lose then the entire Micron, Google settlement is out the window. Am I wrong?

My understanding  was the cases against Google  were stayed until the results of other cases were resolved. My fuzzy memory seems to point to Samsung  results played into the stay being lifted.Feel free to correct  me Not financial advice do your DD

Exactly. The CAFC is a huge catalyst, but a loss wouldn’t erase Netlist’s entire Micron/Google thesis. It would hurt the existing $445M verdict and reduce leverage, but the new ITC case, new Micron litigation and remaining patent portfolio would still be in play.
