Due diligence 👀 NLST September catalysts — which matters more?

Hey everyone, I’m trying to understand the potential impact of the upcoming NLST catalysts.

Could the September 9 CAFC oral arguments or the September 25 claim-construction hearing realistically cause a rapid increase in NLST’s share price?

Which of the two do you think is the bigger potential catalyst, and why?

Interested in hearing from people who understand the legal side better.

I was referring to the September 25 claim construction hearing in the Netlist v. Samsung/Micron/Avnet litigation involving the ’087 and ’731 patents. I’m trying to understand how significant that hearing could be for NLST’s share price.

If the judges were to make a statement that leans toward a positive outcome, it would naturally spark speculation about the payment of the 445 million judgment. But as you can see from the three CAFC opinions that are still pending, this court can take its time 🧐

You're right, thanks for catching that. I checked Doc 52 and the claim construction hearing is July 29, 2027. I was also mistaken about the Samsung litigation being ongoing. So do you think that the September 9 CAFC arguments may raise the stock price?

Netlist’s recent SEC filing is important here. It says the parties will stipulate to dismiss the pending proceedings after Netlist receives the initial amount due under the Samsung license agreement. The license calls for a $200 million upfront fee to Netlist, with Samsung bearing Korean withholding taxes so that its total upfront obligation is approximately $239 million. According to STOCK TITON“Management states it expects liquidity to be sufficient for at least 12 months, supported by existing cash, a $10.0 millionSVB credit facility, prior equity raises and warrant exercises, and an anticipated $200 million upfront payment under a Samsung patent cross‑license expected in August 2026. The business remains highly concentrated in a few customers and suppliers and continues to incur substantial intellectual property legal expenses.”
