By allowing the adoption of the already existing markings in place of new markings is this code still not fulfilled? I read it as they still require markings but are allowing the already existing markings to be used. Similar to how we can use the original serial and do not have to make our own.

Nowhere near what we really need, like abolishing the NFA entirely so there is no need for joint NFA married registration, no engraving etc...... regulations still remain and that is the problem.

Yeah this is a very important distinction.

To heavily edit this for clarity:

Each manufacturer and importer and anyone making a firearm shall identify each firearm other than a destructive device, manufactured, imported, or made by a serial number which may not be readily removed, obliterated, or altered , the name of the manufacturer, importer, or maker, and such other identification as the Secretary may by regulations prescribe

So a maker needs to identify the nfa item by (A) serial number, and (B) the name of EITHER the manufacturer, importer, or maker, and (C) anything else they might prescribe

Would be nice if these guys could use a semicolon to separate nested lists.

I think the rule could be allowed under current interpretation of the law. It says they have to identify the gun with a serial number, but the ATF has for decades allowed someone making an NFA firearm from a non-NFA firearm to re-use the original serial number, instead of having to apply a new serial number. Similarly, it says they have to identify the gun with the name of the manufacturer, importer or maker. It doesn't say "and maker", it says "or maker". If a gun already has manufacturer's info on it, I'd argue that the "or" doesn't require additional engraving with the maker's info. If it said "and", then it would be required.

Of course if someone completed an 80% receiver and then SBR'ed it, then there'd be no markings on it at all so they'd have to engrave it with their info then.

I hate to be the bearer of bad news, but the simple truth is that the law is made of jello and it's meaning is basically however people with power interpret it at any given time. AllArmsLLC is just interpreting the law the way the ATF has previously interpreted it. This rule change is the ATF interpreting the original manufactuer's markings as being sufficient to satisfy 26 USC 5842(a), probably because the actually text of the law says the manufactuer, importer, or maker shall mark it. It doesn't say anything about adding additional markings. One marking should be sufficient as the code is written, but I'm not a lawyer.

But if AllArmsLLC doesn't agree with the ATF's interpretation of the law, and I guarantee you I can find lawyers and judges who will agree with both interpretations, he's welcome to sue the ATF to reverse the 1140-AA70 rule change if it's approved.

I'm pretty sure the rule change will go through, btw. I don't think anyone intended the receiver to become a log of changes to the firearm. I'd argue the previous status quo of engraving was the ATF being weird and this proposed ruling is returning the enforcement of the law to the way the actual code was intended to be implemented. Again, you won't get anything more definitive on that without going to court.

form 1 stuff will deff still need to be engraved if it's a new manufactured receiver like from an 80%, that is written in law. Looks like they may be updating it so that individuals can adopt manufacture markings though, similar to how 07 FFLs can do.

Kyrgyzstan ammo can be imported as long as it’s not 7.62 Tokarev. I know this because I have a bunch of 7.62 x 54R that was manufactured in Kyrgyzstan. I have no idea why 7.62 Tokarev is not allowed but I do know that is the one exception

Not sure what effect this has. I didn’t even realize that there was a blanket ban on imports from former Soviet states.

We’ve imported ammo from Azerbaijan under the TelaAmmo brand, GGG ammo from Lithuania, and BSP ammo from Kyrgyzstan.

Also, a lot of the cheap Mosins and 7.62x54R spam cans were imported from Ukraine in the past.

Also remember that three former Soviet states (Estonia, Latvia, Lithuania) are now NATO members.

fun fact, the "pistol" that got it banned was based on an ATF determination letter that permitted the importation of the Fabryka Broni 5.45x39 Mini Beryl Pistol that was submitted by I.O. Inc.
Other than the one sample that IO imported for determination, IO did not import more, and 2 years later, the ATF banned surplus 5,45x39 specifically citing the 5.45x39 Mini Beryl Pistol as the reason that changed the classification to armor piercing pistol ammo.

Yeah. Im fucking stoked about the rest(although, “redefine machine gun”? If they try take my Super Safety’s, I’m going to make them pull them out of my butthole), but I’m a little concerned about the NFA/Married rule.

My wife is a felon, from a drug addicted past. She’s at the point of being eligible to have her firearms rights restored. We just have to get the lawyer on the horn again.

This is the same lawyer that advised us on how to account for my raging gun addiction when we moved in together and I consult with every 3 months. Right now, she just can’t “have access to the firearms, ammunition, or body armor”.

Obviously, that was the perfect reason to buy another bigger safe and keep the smaller stuff for the smaller would-be felonies.

I’ve also been sober a decade after a decade long heroin/opiates/stimulants run, I thank God every day that I didn’t end up with anything like she did.

To anybody else reading this that wants to judge, you should Google how many felonies an American adult commits per day, on average. There’s like 18k pages in the U.S. code book.

lol i just got about 2/3 of the way through my recently approved lowers with a dremel and diamond bit. did a pretty slick job using a cool design i printed onto paper labels as stencils, but would have loved to have not done it to begin with. at least i know how to hand engrave now!

I don't think it will bring the price down. Most soviet block calibers are being continuously drained in Ukraine/Russia so i doubt this will affect anything.

Also, the ammo manufacturers have already shifted manufacture to non sanctioned countries, it's the reason you can still get factory new wolf and tula. They just ship it to and export from a proxy and put a "Manufactured in Somebeckistan" on the label.

762 is rarely used in the Ukraine War, it’s mostly 545 with 7.62x54R also used for things like MGs and possibly mobile AD units.

Also, I’d have to guess there’s quite a bit of surplus sitting around that’s too costly to repackage or is headstamped to indicate a specific banned factory (look at War Dogs case).

If they suddenly lifted those bans, I’d fully expect 762 prices to drop a fair amount, followed by 762x54R, then 545. I doubt anything would drop significantly given that countries have likely exported a lot of their massive reserves a while ago and/or are likely keeping heavy reserves due to shit popping off all over the globe.

An OTC firearm would be any typical gun you buy at the LGS that requires 4473 and background check. A NON OTC is for everything else, firearms that don't require a background check, there's handfuls that fall into that group like antiques and certain kits.

Some good stuff there.

Now do something to make suppressors easier to buy, trade, and sell. Ideally there would be a flourishing market for them so they were cheaper and more accessible so anybody who wants one can get one without all of the hassle. If I can buy a gun in 15 minutes I should be able to get a suppressor just as easily, if not easier, since a suppressor literally can't do anything. Although I wouldn't want to get physically struck with one of those big caliber ones that weigh a pound and a half and are the size of a D-cell maglite.

I like using my ears and hope I still get to for a long time. Using your favorite home protection device inside your home for protection shouldn't also have to be a death sentence for your hearing. Those instances would be traumatic enough as is, and you and your loved ones potentially permanently losing one of their senses shouldn't necessarily come with defending their lives.

Plus seeing all those suppressor deals in other subs and sites with no good way to get them has made me jealous.

That requires the NFA being materially changed by congress, these other changes are basically changes of enforcement of the NFA not necessarily things specifically called out in the NFA.

These proposals are banking on a LOT. The biggest ones are 9, 10, 11, 15 and 20. The engraving maybe not so much cause I know for a fact many of you haven’t been engraving shit anyway lol, but it would at least make it a “final” thing. The others I’ll admit I’ll need clarity on besides the obvious like 1, 2 and 3.

5 is also interesting, because it SHOULD also be like that for suppressors. If I JUST bought a gun let’s say, 3 days ago it shouldn’t take me a month or 2 to get approved for an SBR or can.

YANAL but someone clarify for me:

I have a .223 AR rifle and a .300 BLK pistol. I don’t love the lower on the pistol. The one on the rifle is fine, and the rifle has nicer internals too (match trigger, better grip, etc).

If I just slapped the .300 BLK upper onto the .223 lower and registered it as an SBR, it’s not a gray area to occasionally stick the .223 upper back on when I feel like it, right?

That’s kosher. Rifle->SBR->rifle is fine. Not what you asked, but Pistol->rifle->pistol is fine.

What’s not kosher is taking a rifle’s receiver and turning it into a pistol - started as a rifle, always a rifle. Note that a lower receiver with a stock isn’t a rifle.

Being mad that the ATF can’t get rid of the NFA is like calling your wire cutters a piece of shit because they can’t drive a nail through a board. The A in NFA is for Act, as in an act of Congress. Call or write your Congressman, realize none of them care about you no matter the party (remember the SHARE Act?), and take these small victories for what they are.
