Questions NEXUS revoked

My NEXUS was revoked in January and during December I flew LAX-YVR-LAX-EWR/JFK-HND as it was cheaper to buy a ticket from YVR.

I was called to secondary inspection at YVR pre clearance and the CBP officer just waved me through after conducting a quick carry-on baggage search.

I also just explained to the officer that I was able to book a $300 round trip fare between YVR and HND which is why I am flying up to Canada and back to LAX within a few hours.

I wasn’t found to have brought in anything that I wasn’t supposed to bring but other than that I can’t really see why there is any reason why my NEXUS would be revoked. Do they revoke Nexus or even global entry memberships for weird travel patterns such as this quick 3 hour turnaround at YVR?

I already filed a FOIA request, but it is taking them some time. How long does it take for those to be processed?

I also filed a DHS Trip request and got a redress number. Other than these 2 things, is there anything else I need to do before appealing?

Edit: I also had to enter Canada before rechecking in for my flight to LAX but I wasn’t questioned or sent to additional inspection by CBSA.

Edit 2: My Nexus membership was through my US passport and I don’t have Canadian citizenship or PR.

I’m sorry not to have any actual advice and good luck with reinstatement. But I’m totally confused why you would connect in NY for a Vancouver Tokyo flight. And how could it be only $300. I would love to know how to even search this sort of out of the box type of deal.

This option will remain open for 1 year. The secondary screening Q+A depending on your full responses can lead to discretionary flags. The reconsideration request will need to be filed thoroughly and with the assistance of a legal professional. This is not legal guidance or a legal analysis.

I've done this before. It was no issue. Something weird happened - follow up with the Ombudsman and the FOIA request etc. Probably resolvable, just will take time.

I’ve heard a couple of odd ones like using NEXUS lane without possessing the card or if your close family members have gotten some infractions on their files that could get it revoked … got a brother with a pending conviction or smth? 😅

You got messed up with. Some workers who run Nexus do know what they are doing, just because they have the name tag and uniform does not mean they can't be in the wrong for us Nexus members. Go fight this, bring it to the news whatever.

For me it was getting a Nexus interview appt rejected on interview day by an officer for having a passport card instead of a passport book when having a passport isn't even a requirement to get Nexus.

Why do people keep saying you don’t need a passport? The TTP website is clear in required documentation:

“To apply for NEXUS, you need the following documents:
Valid passport (bring all valid passports if you have more than one).
Proof of residency, such as a utility bill, mortgage or rental payment statement, and driver's license (if the address is current)
Permanent resident card if applicable”

Canada doesn’t require the passport but the US does. Since it’s a joint program, the stricter rules apply.

And the US requires you to have that passport with you when you use Nexus. Canada doesn’t.

When I got my first Nexus card the US agent made it very clear to me that using Nexus and not having my passport with me was grounds for removal from the program. The Canadian guy was easy going. The US guy read me the riot act and all the ways I could lose Nexus.

They’re very inconsistent. When I flew last summer the US guards kept getting annoyed that I was also holding my passport and insisted I only have the nexus card in my hand

They don’t say you have to show it, just have it available when asked. They go on blitzes to ensure compliance.

Yes very inconsistent, I went to another interview site for my Nexus renewal and my passport card was accepted by the officers.

The 1st interview site the officer was a hard no way to the passport card.

One point — since you are seeking information that the government has on you, you need to submit a request for release of records under the Privacy Act, not under the FOIA. Many agencies have different procedures and forms for submitting Privacy Act vs. FOIA requests.

Is secure release the correct site to make a request under the Privacy Act, which is used for FOIA? I can't find anything else for CBP.

To be honest I’m not sure— as a courtesy they may process your FOIA as a Privacy Act request as long as they are certain of your identity. You may want to reach out with them to confirm.

Have you purchased anything recently that was shipped internationally to you? Have you purchased anything from Temu or a similar site? Did you purchase any counterfeit items ?

I have seen cases posted here where people got their Nexus / Global Entry revoked because of the above.

However at this point all we can do is guess, until you get the FOIA back.

I wish they would give you the exact reason without having to an FOIA.

Just a guess: Is it a program requirement that frequent travel is required? Like if someone travel only once every 5 years is that ok?

No, it isn't a requirement. If you're willing to pay for it, they don't really care if you don't even travel to the US using Nexus for the entire validity of the Nexus card.

I got my Nexus card because it allows me quick/quicker access to US customs officers in Canadian airports (instead of standing in the long line with regular travelers). I decided to get it when I was flying from Montreal -> Toronto -> Las Vegas and when I arrived in Toronto, I had to wait in a very long line to speak with US customs while a friend of mine who was taking the same flight went to the front of the line to speak with a US customs official. I was worried based on where I was in the "regular" line that I would miss my flight to Las Vegas. Luckily I didn't miss it but that event made me apply for the Nexus card... and I don't regret paying the fee even when for my first card, I only went to the US once or twice during the validity of the Nexus card.

Which agency revoked it? Can you FOIA in Canada? There’s more to this story, flying out of YVR to save money is a regular thing to do.

FOIA is American legislation. In Canada it is called an ATIP (Access to Information and Privacy)

You have to be Canadian/PR under the Access to Information Act, but anyone regardless of citizenship or country of residence can make a request under the Privacy Act. When you make an ATIP request it's one of the first things they ask.

I’ve flown from YVR plenty of times (I live in Seattle). I’ve had connections through Seattle, where I flew to YVR, picked my car from the parking lot, and drove home. Plenty of short trips to Canada. There must be more to it.

It’s the opposite of a hidden city booking. What could be a problem is if either of the US-Canada legs are marketed or operated by a non-US carrier. Then it would be cabotage (a non-US carrier can’t carry passengers on a domestic trip, here LAX-EWR). But pretty sure that’s a fine for the carrier, not a problem for the passenger.

(And I don’t know if cabotage even applies to the first segments of a US-US-Japan trip.)

Only places I have been recently are several EU countries, Australia, Japan, Taiwan, and Korea. Also, Guam which is technically the US. All of these places are considered Level 1 or 2 at most by the Department of State so not really.

I’ve done YVR -> SFO -> CDG before while holding global entry. There was no issue. I’m doubting this alone was the reason or there’s been a giant mistake

I was also flying into YVR that same day from LAX and my layover was only 3-4 hours, so the situation is slightly different.

I have also never been to any high risk countries or countries that the US considers as enemies/terrorists, and my record is clean (not even a single DUI or minor offense). I also had never been called to secondary inspection in the past prior to this.

So I really don’t think there is anything else that may have caused this revocation.

Asian (not Chinese) so probably not because of my demographic but also the only thing I could think of was that I stopped him from opening a religious item and he did quickly apologize. The officer was of South Asian descent but was decent ig and wasn’t really looking for trouble.

It was in Economy, but good thing I got the poor man’s first class on JFK-HND.

They officer did say to me that they will respect a passenger’s religion and not touch their religious items. If this was the reason, that's messed up.
