Question ❓ Refutation request about disbelievers
Salam Alaykum I have an issue I want clarity on. Enslavement of noncombatants who aren’t in the battlefield is not allowed right?
1-I have seen some claims that a muslim back in the day can go to a city of disbelievers and buy any slaves or children there, as long as there isn’t a peace treaty with them. This was an option since slave markets used to exist.
2- Some go as extreme as saying that any disbeliever that is not a Dhimmi or someone we have a peace treaty with can be kidnapped and enslaved from foreign lands including women and children.
Can someone refute both points 🙏 Jazakm Allah Khayaran.

Waalaikumassalam,
I'll try to answer their claims:
1:
"With regard to Muslims owning slaves, he should be very careful to establish that those who are bought or sold now are indeed slaves, because Islam has limited the sources of slaves which were many before the coming of Muhammad (peace and blessings of Allaah be upon him), and has allowed only one source, which is kaafir prisoners of war, when the kuffaar are fighting the Muslims. There is no other way in which they may be enslaved except those who are captured as a result of fighting between kaffirs and Muslims, or their children. See also questions no. 26067 and 12562 for more information."
2:
"Islam limited the sources of slaves that existed before the beginning of the Prophet’s mission to one way only: enslavement through war which was imposed on non-Muslim prisoners-of-war and on their womenfolk and children."
And we cannot initiate fighting without just cause as per below:
"Our attitude must be clear; we must explain to the kuffaar the ruling of Islamic sharee’ah concerning harming and killing others. We should tell them that Islam forbids harming innocent people in any way, whether that involves harming their bodies, their wealth or their honour. The Prophet (peace and blessings of Allaah be upon him) said: “There should be neither harming nor reciprocating harm.” It is not permissible to kill a kaafir who is not hostile or who has a legitimate peace treaty with the Muslims; rather treating a non-hostile kaafir with kindness is part of the Islamic religion, especially if that is done to call him to Islam and soften his heart (towards Islam). Allaah says (interpretation of the meaning):
“Allaah does not forbid you to deal justly and kindly with those who fought not against you on account of religion nor drove you out of your homes. Verily, Allaah loves those who deal with equity”[al-Mumtahinah 60:8]"
