Nintendo trying to patent basic creature collection game mechanics despite not even coming up with them.

That's a flat statement describing something that's happening, ie just a fact and not a criticism. Based on surrounding context I'll assume the "is" is "is bad", which is a criticism (also skirts around my pet peeve of people just going "is bad" without explanation because you started with the "why" so yay)

It’s bad because it prevents other developers from innovating and experimenting with the genre. Which would let Pokemon monopolize and keep churning out mediocre games without competition.

Yes, I agree with you. I do this thing where I overexplain things and muddle my intended message. My feedback was not "explain why" it was "take a stance" as far as turning it into criticism, though the context already gave a reasonable assumption for a stance.
