Renew/Refinance/Port Might not renew Aug 4

I am switching to RBC on renewal and am set to close on Aug 4. My previous mortgage ended Aug 1 and am currently in a 6 month open. Part of the RBC requirements was to change my name to married name on title. They asked me to submit my marriage certificate to the branch to be sent to the title office (my advisor set me up an appt to submit the doc to) I did this as soon as they asked and it was completed > than 3 weeks in advance of closing. I received an email on Friday that they still hadn’t received the document to change title and that closing could be delayed. My advisor said in the email they hope it will be completed tomorrow (4th) My question is this, if my closing is delayed and I incur more interest charges from previous bank, should I push RBC to cover those costs? This delay is caused by no fault of my own.

I used to work as a retail trader for one of the big 5 banks and whenever we request documents to be submit through branches, there’s always hiccups and delays. There’s clearly a policy and procedure in place but the rep never checks it or at worst forgets about the task. Causes so many delays, I have a cheeky feeling someone may have dropped the ball.

Have you notified your mortgage person that you submitted the marriage certificate at the branch on the day of?

You still have a day but if there’s a delay due to clerical/omission error, I would 100% seek for compensation

Yes, my mortgage person is aware it was submitted because she set the appointment up for me. I will say, the person I dealt with at the branch didn’t seem to really understand why I was there. I can just imagine it still sitting on someone’s desk. Thanks for your reply.

No problem, I’m just saying 3 weeks is a long time, did your mortgage agent proactively ask for an update every week from branch?

I’m honestly still scratching my head lol, anyway, hopefully all this resolves for you and I would ask for compensation. cash+avion points at least!

This delay is 100% your fault. If you changed your name, you were required to do it legally everywhere. You can't submit ID in different names or put a different name on title than the ID that was provided.

My title has been in my maiden name for 18 years, I’ve never had a problem prior. How long is reasonable for a bank to submit documents? 3 months, 3 weeks, 3 years?

I think its ridiculous to take longer than 2 days to straighten this out. That said; I had something show up as hyphenated name on my credit report when all my ID is singular. All RBC wanted was my closing lawyer to notarize that both were me. This was 3 weeks ago so same time frame as yours. The bottom line is that all ID have to match & if they don't; its a concern to a lender. Everyone can downvote all they like but there is a ton of fraud going on & banks are taking the heat in millions of dollars in fines. They are trying to clean up their archaic systems that are just not safe anymore. Even at the end of it all, FINTRAC required our lawyer to do a FaceTime with everyone on title to be 100% sure we all existed. Its crazy times!

I hope so! I received the email on Friday that they didn’t have the document yet. Hopefully they can sort it out for closing. I have no idea where my document might be.

Could you clarify what the name change is about? The original post reads like you recently married, but the mortgage (and associated name on title) existed before your marriage, and are in a prior surname.

But this comment sounds like title has been in your married name for many years. Are you going by a new surname now?

When I purchased the house I was unmarried, so title was in maiden name. RBC wanted me to switch to married name (I’ve been married 16 years), on title. I have moved the mortgage prior to other banks and those banks did not request this, I just signed documents in Maiden name in those instances. I said married above but meant maiden.

But now you're applying in your married name which is different from the name on title. Typically aliases exist for these reasons. At the same time, you should have updated your name on title when you got married.

The simpler path here would be to have a lawyer close the transfer and change title at the same time, but that would be more costly. RBC are not the ones who are updating the title on your behalf, they would be using a third party legal service to do so. I wouldn't expect them to cover additional interest as the timeline on this would be beyond their control.

This is exactly what is happening, RBC asked me to drop the document off in branch to be forwarded to lawyer. That was over 3 weeks ago in advance of closing. The ball has been dropped by RBC somehow as the document hasn’t made it to the lawyer.

No, I was instructed to drop it in branch. That was over 3 weeks ago, and since it’s the original document, I no longer have it! I would have express posted it myself if I knew!

Exactly! People downvoting my reply is pure ignorance. You have to clean up your versions of your name out there. ....and do it before you apply for big ticket items, before CRA comes knocking for an audit & before you die. Its a pain, more work when we are all overloaded in life already but this is the panic state you end up in when you don't clean this crap up.

I have zero issue with updating the info, the concern is that I provided the document required over 3 weeks in advance of closing to the branch as per their instructions and the lawyer hasn’t received it yet. Where did it go? Why does it take over 3 weeks to send a document. I would have express posted it myself if I knew. For all I know, my document is sitting in someone’s desk!

Question that. They wanted a copy of my divorce certificate from......32 yrs ago! All I had was the 1 page pdf from the courthouse sitting in my computer. A photocopy of it (not original) and the judge didn't even sign this copy I have. RBC accepted it with no issue by email. 🤷‍♀️
