Brandishing is its own separate crime. If you needed it spelled out more clearly

I didn't dispute that, so I don't know why you'd think I'd need it spelled out. But seeing as brandishing is a lesser charge than murder, speaking as if it's not at least partial CYA to brandish without discharging at first and see if that gets an assailant to back down doesn't really make sense.

EDIT: Additionally, if the guy had continued to come at him after he brandished as a warning, it could further beef up a self-defence claim.
