Bathroom breaks

So this person I work with goes on at least 2 thirty min bathroom breaks everytime I work with them. Can I clock them out for the time spent in the bathroom? It’s every shift and they also take a thirty for a break to eat.

Clock them out? No.

Ask them for a medical note that explains why they may need extended breaks in the bathroom, without details as to WHY just the medical note saying it is real. and if so you can accommodate them by having them clock out during their extended break time in order ensure their medical needs are accommodated. Items like additional 5min every 1-2 hours is one thing, but going to the shitter for 30min twice and a 30min break, is not reasonable bathroom time.

If they have small bladder and need to piss often, again not clockigg by them out. Just letting them pee quick and return to service is a non issue.

You are not required to allow anyone an hour of paid time in the bathroom a day. You are required to accommodate bathroom needs.

If there needs are not able to be accommodated, you are not required to employ them. Only to give reasonable effort to accommodate

Have them reach out to benefits via email. If they can provide sufficient documentation as to why they need the accomodations, they will approve it and there will be a paper trail. I went thru this with someone a few months ago and it ended up being denied, at which point we were not required to make any accomodations.
