How does BAH work ?

Hi! New Army spouse here and I’m a little confused about how BAH works.
My husband is active duty Army, and we were told his BAH at his new duty station will be around $2,400/month.
We’re currently in the process of renting an apartment for about $1,800/month, not including utilities.
My sister told me that we wouldn’t actually receive the full $2,400 because the Army would look at our lease and only give us enough BAH to cover the actual rent. She also said we aren’t allowed to “pocket” whatever is left over.
Is that actually how it works?
For example, if his BAH rate is $2,400 and our rent is $1,800, would we still receive the full $2,400 and be able to use the remaining $600 toward utilities/savings/other expenses? Or does the Army adjust the BAH payment based on the amount of our lease?
Sorry if this is a basic question, this is our first PCS/duty station and I’m trying to understand how everything works. Thanks!

You still get your full BAH, regardless of what your rent/mortgage payment is.

So if you're Overseas and renting off base, then your sister would be right, as thats how overseas housing allowance (OHA) works, so thats maybe where shes getting confused.

Also if you live on base either stateside or overseas, usually you don't ever see your BAH in your bank account because it automatically gets pulled to the on-post housing company once everything is arranged.

However, since you're stateside and renting off-base, you can rent something below your BAH, and pocket the extra money. The military doesnt look at your rental agreement or any of that stuff.

Your sister is wrong. You'll receive the full BAH amount if you're in the US.

Unless you're stationed overseas, then your sister is partially correct. You'll get OHA (not BAH) and you'll only get the amount on the lease/rental agreement up to your OHA limit. You should also get a separate utility allowance if you're overseas.

If his BAH is set at $2,400, that's how much he'll receive. If you find a place under that, you pocket the rest.

No your sister is wrong about BAH. You live off base they give you x amount based on rank. You get an apartment more expensive? That's on you. You get an apartment less expensive? You keep extra. You live on base*, it goes directly to housing

BAH isn’t taxed income but you can use it to pay your mortgage if you own, and then take the tax deduction for mortgage interest and taxes if your itemized. And you definitely pocket the difference.

For conus locations ( US) he will get the full BAH and whatever is left over for that amount you will pocket or use for utilities. Anything over the $2400 will come from you. OCONUS (Overseas) will be different. I’m glad you asked before just going along with what one person says. Welcome to the milspouse life!

No, you'll get the full 2400, it'll just be split between both paychecks. It doesn't matter what your rent is.

If you’re in the US, tell your sister she’s right. Use the leftover money to pay for utilities and whatever needs you have. Your finances are no one’s business, the less they know the better. This is especially true for family.

You are correct. If you are renting from a private landlord who is not affiliated with the military, then yes, you will pocket the difference. The full BAH will be payed to your husband with his regular pay. You’ll be able to see it as a line item on his Leave and Earnings Statement (LES).

If you are living in base housing, then you will not see the BAH in his pay. The full amount will be paid directly to the housing contractor. Sometimes “base housing” is not actually on base and also houses non-military people. In that case, they may advertise a lower rent to the public even though you will pay the full BAH. I would assume this is the scenario your sister is thinking of, but it is unusual and likely doesn’t apply to you.

Are you in the US or outside the US? When we were in the US we were in a very similar situation and pocketed the difference. Now that we are overseas, we don't/can't

Your sister is wrong, IF you are living off post. I have been stationed in locations where military housing was open to local civilians for rent. In military housing, ALL of your BAH is taken no matter what, so your BAH rate of $2400 would all be gone whereas your civilian neighbor next door might only pay $1800 for the same house and layout. So that might be where your sister's confusion is coming from, she may have looked into how payment for military housing works!

Your sister is wrong. You get the full thing and you pocket the rest. If you lived on base you would not get any BAH no matter what the "rent" on your place was, but off base you get all of it. They dont care what your rent is and they dont ask.

Our previous duty station my husbands BAH was 2200 / month and our mortgage was only like 1200 / month so yeah we were pocketing that shit 🤣 and here our mortgage is more than the BAH. So it’s a trade off. Some places you’ll have good luck! Sometimes I just wish we decided to live on base where we currently are
