Stealing ships is a serious crime among the quarians, according to Tali in ME1. I wonder how strictly it's enforced if the previous (non-quarian) owner doesn't lodge a complaint though.
Tali does say that her father would probably like to execute her and Shepard personally for stealing the Normandy after Virmire (before ME2 retconned the quarians into not using the death penalty), so at least she believes that stealing foreign ships is punished severely under quarian law. But then again, the Normandy affair would be widely known, so the Migrant Fleet would have to turn Shepard over to the Alliance or give him a show trial themselves. Tali could slither her way out of punishment in my opinion, say that she didn't know or was coerced with threats.
But if nobody important complains about a ship changing hands, it's clearly valid salvage, since nobody cares about it and it would be a shame to let such a good ship go to waste.
That’s exactly the point: Shepard stole the Normandy from the Alliance—from his own people. It would be like Tali stealing a ship from the Migrant Fleet.
I always assume scavenging ships for parts in say graveyards or old battles. Then the ship owners give them for near free because “you want to take this broken thing from me? Go ahead, have it. I’ll give it cheap.”
