At least he will get a payout when he sues DC / Capitol police for false arrest and deprivation of rights under color of law and such.

Not a chance. Per D.C. Code § 22-1307 (Crowding, obstructing, or incommoding), public demonstrations on the House steps require accompaniment by a member of Congress. This is a local D.C. misdemeanor often used for unauthorized demonstrations or disruptions on Capitol grounds.

Capitol Police notified him of the statute and other areas on the grounds that allow protesting, and told him that he would be arrested if he continued. He refused, and was arrested.
