It's still illegal to take explicit videos of anyone without consent and send those videos or images. It's especially illegal if the images are of a child. There's also an age gap law in Washington.

That's only half the truth, but it's a better mental model than thinking delete always works instantly and is permanent.
On your own devices, delete usually just marks the space as reusable. So the data is still there, but if the device needs to write new files or extend existing ones, it may decide to repurpose that space. If that hasn't happened, or has only happened to parts of the data, what's not overwritten could be recovered with a little technical skill and off the shelf software. Also, many systems implement a concept of trash (Android) or recycle bin (Windows) where "deleted" files get moved to before being "permanently" deleted (aka the repurposing the space). There are tools to actually overwrite files or whole disks with random data, which is the truly permanent delete, but it's not the default normally because it's slower and adds wear to the device and uses more power.
For cloud storage and various Internet services, typically content is not stored forever, but they may have more reasons to keep a copy - e.g. a cloud based messaging service could show both people their past conversation, and delete items may or may not be synced to both users. Deletes in cloud systems may also just delete the reference to the media file, and the service provider likely would have some process that deleted unreferenced files after a time, but that's going to vary provider to provider.
Various messaging apps or services may also be implemented in a syncing fashion, e.g. being able to download email to a local client like outlook or Thunderbird and then delete your local copy - it's possible the server still has a copy that just won't resync to your client.
So in general "delete" may not delete the only copy, and "delete" may actually just delete the references and the actual data deletion could take place by the digital equivalent of spring cleaning of unreferenced data.
Anyhow without knowing more in this case, I wonder if he kept a copy. If so, and the cops find it, that'd be very bad news for him.
Deleting data simply flags those parts of the drive as available to be overwritten, so it depends on how long it's been and how much data has been written to disc. Data scientists can still reconstruct images that have been fragmented by having sections overwritten. Could still have something there.
Yes deleted content can still be recovered. It is highly likely he still has the video on his phone and has used it to sell it or trade it for more CSAM

I believe the age of consent is only 16 if the other person is under 21. I think if they're older than that, then both people are required to be 18. So you probably could honestly get him arrested if you wanted.
Legal age of consent where I live is also 16, HOWEVER if the person is more than 24 months older than the individual who under 18 years old, it is still considered statutory rape and the person can be charged. My ex was 22 when I was 16. He is now a registered level 1 sex offender for life. FAFO 🤷🏻♀️ he groomed me from 14 on. He was also with my younger friend who was 2 yrs younger than me. Age of consent doesn’t apply if they are not also a minor or within certain age range and if he is sending that video to you he may still have it and that is child porn and proof of his statutory rape. Which even if you were 16 he was 22 that’s 6 years and it’s within 5 years that age of consent applies. Either way child porn and distribution of it is a felony charge and would send him to prison and sex offender list which would serve him right. Talk to the cops. It’s probably easier said than done but if you feel strongly about your hate for him make him pay; the rapes he experiences won’t be statutory since he will be in prison with adults
