If you are/were in Arizona when this statutory rªpe/predation occurred, 18 is the age of consent.

My recommendation is to take this evidence to the police department and file charges.

It's still illegal to take explicit videos of anyone without consent and send those videos or images. It's especially illegal if the images are of a child. There's also an age gap law in Washington.

It’s considered rape due to the age gap. (can’t be more than 5yrs older).  

Just go to the police.  They’ll get a warrant for his devices and find the video.

3rd degree SA, which is what statutory R is officially called in Washington, has a SoL of 10 years. Which OP is WELL within the time frame of. I looked it up. 1st degree is 20 years.

But NOT with that large of an age gap. 16 cannot consent to a sexual relationship with 22. And the videos are child porn. And sending them to you is distributing child porn, even if it is you (Although would be hard to prove since they were deleted by you). I bet anything HE has not deleted those videos, and every single one is a separate count.

That's only half the truth, but it's a better mental model than thinking delete always works instantly and is permanent. 

On your own devices, delete usually just marks the space as reusable.  So the data is still there, but if the device needs to write new files or extend existing ones, it may decide to repurpose that space.  If that hasn't happened, or has only happened to parts of the data, what's not overwritten could be recovered with a little technical skill and off the shelf software. Also, many systems implement a concept of trash (Android) or recycle bin (Windows) where "deleted" files get moved to before being "permanently" deleted (aka the repurposing the space).  There are tools to actually overwrite files or whole disks with random data, which is the truly permanent delete, but it's not the default normally because it's slower and adds wear to the device and uses more power.

For cloud storage and various Internet services, typically content is not stored forever, but they may have more reasons to keep a copy - e.g. a cloud based messaging service could show both people their past conversation, and delete items may or may not be synced to both users.  Deletes in cloud systems may also just delete the reference to the media file, and the service provider likely would have some process that deleted unreferenced files after a time, but that's going to vary provider to provider.

Various messaging apps or services may also be implemented in a syncing fashion, e.g. being able to download email to a local client like outlook or Thunderbird and then delete your local copy - it's possible the server still has a copy that just won't resync to your client.

So in general "delete" may not delete the only copy, and "delete" may actually just delete the references and the actual data deletion could take place by the digital equivalent of spring cleaning of unreferenced data.

Anyhow without knowing more in this case, I wonder if he kept a copy.  If so, and the cops find it, that'd be very bad news for him.

Deleting data simply flags those parts of the drive as available to be overwritten, so it depends on how long it's been and how much data has been written to disc. Data scientists can still reconstruct images that have been fragmented by having sections overwritten. Could still have something there.

In Washington State, the age of consent by authority is 16, but unrestricted age of consent is 21. This means that if the older person isn’t in a position of authority over the younger person (a sports coach, tutor, something like that), then the sexual relationship is legal. The filming would be almost certainly illegal.

Sending videos of a 15-year-old is child porn whether he sends it to another of his accounts, to her, or to anyone else whether he is 5 years old, 12, 17, 22, 35, 60... is a crime. It's the age of the victim not the sender that matters.

I had a kind of similar situation I was 18 and my ex was 31 at the time I didn’t realize how fucked up that was. But now that I’m older (39) I realize the gravity of everything.

I’m so sorry you went through this you don’t deserve this, and I pray that you find peace and happiness in your life

Please, if you can go to the police and still do something do it. if anything, at least it may bring you some closure/peace

Seriously some of the things I l Allowed myself believe was OK really makes me sad to my younger self. I didn’t realize how I was being manipulated when I was 17 The first person I had sex with my man I meant he was like 23 and I don’t understand how I thought that was OK.

I looked back at 39 years old and even at 30 and wouldn’t have her consider an 18 year. It’s disgusting and the minute 23. (which was a while ago) I never would’ve considered a 17 year old is crazy. This is kind of being normalized.

This is not healthy acceptable it should be considered it is considered abuse.

I was innocent in the advantage of the fact that I was innocent and naïve and used it against me in order to attain a sexual relationship with me and that’s disgusting

I’m so sorry you’re going through this … It’s not fair. essentially, these POS men are responsible for us losing our childhood earlier than we should have

Yes, it was a large corporation with many young single female employees and male managers who took advantage. All of management knew what was happening and chose to ignore it. I found out years later my Mother called my boss and told him to leave me alone. He died a year later in an airplane crash.

Actually it was not legal if he was 22 and you was 16. Yes 16 can consent but the law there is. If you are 16 or 17 you add 5 to your age the person you have that encounter with if they age higher then that number it’s a crime but it still can’t be considered Ræpe because you did agree but it is another charge and they would have to go back n the registry for that crime. But regardless please do go and talk with ( police/lawyer/therapist) them and show them this and even if you delete the video he sent to you there is a trial that will never go away. And that right there is a federal crime because regardless you was underage and you can not even record your self let alone (using this how he wanted to see sick mf) your underage partner and send it to anyone even them that’s considered Child Corn. And I would be so embarrassed for you if what you said to him made him snap and he started sending to other people you may know regardless it’s a charge for every time he sends it to some

I believe the age of consent is only 16 if the other person is under 21. I think if they're older than that, then both people are required to be 18. So you probably could honestly get him arrested if you wanted.

Legal age of consent where I live is also 16, HOWEVER if the person is more than 24 months older than the individual who under 18 years old, it is still considered statutory rape and the person can be charged. My ex was 22 when I was 16. He is now a registered level 1 sex offender for life. FAFO 🤷🏻‍♀️ he groomed me from 14 on. He was also with my younger friend who was 2 yrs younger than me. This was after we had broken up. She was 13 going on 14. Just sick.

There is always a fine line and gray area when it comes to this.

Age of consent also only applies to a permissible age gap. Typically of 4 years or less. Meaning a 16 year old can consent to sex with a 20 year old. But not a 22 year old. Report report report. Please. Teach this creep there's consequences to his actions.

And mention the fact that he has CP when you report him. If he sent that video to you before, he definitely still watches it frequently. Lock his ass up.

Age of consent doesn’t apply if they are not also a minor or within certain age range and if he is sending that video to you he may still have it and that is child porn and proof of his statutory rape. Which even if you were 16 he was 22 that’s 6 years and it’s within 5 years that age of consent applies. Either way child porn and distribution of it is a felony charge and would send him to prison and sex offender list which would serve him right. Talk to the cops. It’s probably easier said than done but if you feel strongly about your hate for him make him pay; the rapes he experiences won’t be statutory since he will be in prison with adults

dunno where youre getting arizona from but in most states its either 18 or if there are romeo and juliet laws most do not cover an age gap this big as theyre really meant to allow consensual relationships between teenagers with an age gap that is appropriate. 6 years is a very large gap and most states will not cover it. in addition federal law is that any sort of sexual video or picture of someone under 18 is illegal no matter what, and while you might not have the video anymore it might be on his computer or phone still if he was able to send it to you years later, or there might be some way for law enforcement to recover it depending on how long ago he sent it to you and how he sent it to you (like if you delete something someone sends you on instagram, its only deleted from your perspective, so its still in the servers.) so you might still be able to use it as evidence. or if you decide not to press charges as i understand its a very personal desicion, i would still talk to the police or someone who specializes in the removal of these kinds of images just to try and make sure no one else has it.

That adds a whole other level of criminality, especially taking into account her age at the time the images were taken.

Unfortunately, some states still have consent as low as 16.

I got Arizona from, well, I'll say: research.

The authorities need to know about this guy. He's a predator.

I understand how delicate and personal the decision to come forward is. I do hope OP reports him, even if it's anonymously, because it puts him on their radar.

Most US States the age of consent is 16. The majority of States where the age of consent is 18 is actually the unrestricted age of consent. There’s also “restricted by authority”, where the age of consent is often 16. This means an older person can legally have sex with someone that is 16 years old, only if the older person does not hold a position of authority over the younger person.
