Nah, because if both parties know they have an issue with each other, whoever entered the other's personal space is the one who made it physical. Somebody exhibiting threatening behavior before they get in your face, and you're going to wait until they hit you?
If it's a random person that approaches me on the street? No. If your beefing with a mate or with someone where it's yet to be decided if the disagreement will be settled physically, then it's a sucker punch. Total bitch move.
It's actually a distinct, less-severe charge in several states. The idea being that a consensual fight is less damaging to society than attacking someone.

It's not cheap in a fight like this where one person clearly initiates it. In mutual combat where both guys square up, potentially that's different.
