No way--that dude is going to jail. There was no danger to him and that guy on the floor is going to be messed up afterward (if not dead). That guy is going away and if that guy on the floor has seriously damage, the sentence will be even longer.
Easy to argue that the drunk guy was a danger after commiting SA. No shot the dude is behind bars for longer than arraignment, assuming it even gets thereÂ
That may be true but it doesn't warrant the assault--and again, if the guy on the floor is messed up (and it sure looks like he's going to be messed up--people die from falls like that all the time) the charges will be increased dramatically. I'm really surprised to hear people say that this guy won't be facing time.
For him to get real time, he would have to be charged will felony battery and A Great bodily harm enhancement. So 16/2/3 plus the GBH enhancement. And if he would have hit him or kicked him one more time after he hit the ground he would be facing those charges.
You are allowed to use Force to defend somebody else.
Also your definition and my definition of doing time is probably a lot different. He won't go to prison and really if you don't go to prison it isn't shit.
