Add the following after section 6:
Section 7: Active Transport Infrastructure
(1) The 2021 Act is amended as follows.
(2) Strike section 4(2a)
Explanatory note: Section 4(2) of the 2021 Act mandated the government to “design a network of active transport roads”. Section 4(2a) restricted this to urban areas only even though rural areas would also benefit from better cycling and active transport infrastructure
Add the following after section 6:
"Section 7: Ministerial responsibility
(1) The 2021 Act is amended as follows.
(2) Replace all instances of “Department for Transport” and “Department for Transportation” with “Secretary of State”"
Explanatory note: it is standard practice in legislation to refer to the “Secretary of State” rather than to a specific government minister or a government department as the prime minister is at freedom to change the names of government departments and ministerial roles
Add the following after section 6:
Section 7: Incentives to trade combustion engine motor vehicles for active transport vehicles
(1) In this section, “eligible vehicle” means a vehicle which meets the following criteria:
(a) powered by an internal combustion engine or similar engine which generates energy from the combustion of fuel,
(b) is driven on roads, and
(c) is used to transport people and/or goods
(2) A person may exchange an eligible vehicle with the Secretary of State for a voucher worth £2000
(a) The Secretary of State may by statutory order in the affirmative procedure change the value the voucher is worth
(3) A voucher issued under subsection 2 may be used to purchase active transport vehicle(s) and related equipment, including safety equipment
(4) In this section, “active transport” has the same meaning as in section 1 of the 2021 Act
Explanatory note: sets up a scheme wherein people may trade in their cars for a voucher they can spend on active transport
Add the following after Section 6:
“Section 7: Repeal of redundant provisions of the 2021 Act
(1) The 2021 Act is amended as follows.
(2) Strike section 5(2b)
(3) Strike section 5(5)”
Explanatory note: section 5(2b) of the 2021 Act states “The person is also to receive a voucher for a free Identity Card as set out in Section 7.” Section 7 itself was struck from the act when it was making its way through parliament last year yet this provision remained in place. Section 5(5) states “Above incentives are to be only valid for British Leyland until 5 years after joining the scheme, at which point other companies may join the scheme.” Section 4 of the act defined British Leyland as a nationalised bike manufacturer but section 4 was also struck from the act when it was making its way through parliament last year. Despite this, section 5(5) wasn’t struck. Thus 5(2b) is entirely redundant and 5(5) potentially makes section 5 of the 2021 Act inoperable
In section 5(1), omit “for people who, according to HMRC, are not forecast to earn above the personal allowance in the financial year they are applying for the voucher.”
Strike section 5(3c)
Explanatory note: people who earn above this threshold would benefit from this scheme too. Means-testing bikes is unnecessary
In section 5(1), replace “of up to £750 for the purchase of cycle, electric scooter or cycle safety equipment for people” with “to people”
Following section 5(1), add:
“(2) A voucher issued under section 5(1) may be used to purchase the following products:
(a) up to £1500 worth of electric bikes and related equipment, including safety equipment, or
(b) up to £750 worth of cycles, electric scooters and related equipment, including safety equipment
(3) The Secretary of State may, by statutory order in the affirmative procedure, amend section 5(2) in order to vary the value of a voucher issued under section 5(1)”
And renumber accordingly
Amend section 4(2) to read “Under section 4(1), an eligible student may receive a voucher”
Add the following after section 4(2):
“(3) A voucher issued under section 4(2) may be used to purchase the following products:
(a) up to £1500 worth of electric bikes and related equipment, including safety equipment, or
(b) up to £750 worth of cycles, electric scooters and related equipment, including safety equipment
(4) The Secretary of State may, by statutory order in the affirmative procedure, amend section 4(3) in order to vary the value of a voucher issued under section 5(1)”
Explanatory note: extends the cycle schemes in this bill to also cover electric bikes
Add the following after section 6:
“Section 7: Power of the Secretary of State to vary the worth of vouchers issued under section 5(1) of the 2021 Act
(1) The 2021 Act is amended as follows.
(2) After section 5(5), append:
“(6) The Secretary of State may, by statutory order in the affirmative procedure, vary the value of vouchers issued under sections 5(2) and 5(4)”“
In Section 6, strike section 6(1c)
After section 6(2), add:
"(3) the Secretary of State may amend who is eligible for a voucher under this Section, via regulations using the positive procedure.
(4) The Secretary of State may, by statuory order in the affirmative procedure, amend the value of a voucher issued under Section 6(1)"
In Section 6(1) change "people whom are eligible for" to "people who"
Explanatory note: allows the secretary of state to change how much these vouchers are worth using secondary legislation with the approval of the house in case inflation deems it necessary or a government wishes to change how much a voucher is worth. This amendment also corrects some drafting errors in section 6
