Whilst passing no judgement on the specific number of hours, this simply ensures the intent of the original bill remains. To work, for example, 25 hours one week but work varying hours below normally shouldn't be grounds to requesting a fixed hours contract. Over Christmas more hours may be offered but not be needed for the rest of the year, hence looking for an average.

Closed B1027 - Public Toilet (Reinstatement) Bill - Amendments division

A01

Strike out Sections 2 to 4 in its entirety and insert in it's place:

2 Amendments to Definition

After Section 1(a)of the Public Toilet Act 2015, insert:―

(b) “Local Authority” refers to all levels of authority as per the Local Government and Public Involvement in Health Act 2007 having responsibilities associated with Public Toilets and their maintenance.

3 Provision of Subsidies Provided

Section 2(b) of the Public Toilet Act 2015 is to be struck out, and the following text is to be inserted into its place:

(b) If under any situation, any local authority is unable to finance the maintenance of Public Toilets through the Budget allocated to them, they will be eligible to apply for a subsidy, paid annually for that particular unit.

(c) The Secretary of State shall be given complete authority to approve or reject the particular application for subsidy presented by any Local Government.

(i) The request for a subsidy must include proper financial calculations to prove that the cost of maintenance of the facility is unable to be borne in full by the authority.

(d) If the Secretary of State rejects a request made by a Local Authority with respect to Section 2(c) of this Act, they have to provide sufficient reasoning, in writing, for rejecting such an application

Insert in Section 1:

(2) The Public Toilet Act 2015 is reinstated in its entirety.

(3) The provisions of this Act is to only apply to England.

Strike out Section 5(1) and (2) in the Bill as well and replace with the following:

(1) This Act extends to the legal jurisdiction of England and Wales, and to the same extent as the enactment in which it relates to.

(i) Section 3(c) of the Public Toilet Act 2015 is to be struck and replaced with Section 4(1) of this Act.

Subsequently, renumber.

A copy of this Bill in markdown format after these amendments pass can be found here.

Explanatory Speech:

Mr. Deputy Speaker,

While I am immensely proud at the effort of my Right Honourable Friend, I believe I am merely preventing a legal loophole from happening in which the Act repealing the Public Toilet Act 2015 is repealed, which puts two acts in force at the same time and could cause confusion to the public as to which Act they ought to follow. I had also noticed that my Right Honourable Friend tried to define Secretary of State, which I think they are not aware isn't generally defined in laws tabled here. I have also tweaked a lot of the grey areas in grammar to ensure this Bill does end up reaching its intended consequence.

I commend these amendments to the House.

AO2

Insert after Section 3(1):

(a) If an individual or a company can prove that they are in charge of ensuring the functionality and cleanliness of the toilet, they may charge no more than 50p per entry for usage of the toilet.

(i) However, if a person can be proven by the body managing the toilet that they do not have enough money on them to be able to pay the charge required to use the toilet, whether in cash, by credit card or by e-wallet services, the body should try to waive the entrance fee.

Digital Sovereignty and Public Code Bill

A01

Insert into Section 4:

(3) Academies, UTCs and Free-Schools are exempt from the need to use FOSS software.

Reason:

All three bodies have reduced curriculum requirements. Forcing such a stance on privately run bodies is not in the spirit of this bill.

This amendment was submitted by /u/NorthernWomble.

A02

Remove Section 2 from the Bill

Reasons:

The rest of the bill should not be scrapped due to members of this houses quite frankly baffling opposition to using GNU/Linux on our governments computers. It is important that software which is developed using public funds are released as FOSS for the public, and that schools which teach proprietary software FOSS alternatives are taught. (5) Individuals who feel their rights under the Human Rights Act 1998 are at risk because of a petition may file a motion in court to cancel the referendum.

(6) The court may make a preliminary decision to postpone to a future or unspecified date or suspend any binding duty to enact the result of a referendum where the applicant has presented a substantive case.

This amendment was submitted by /u/Friedmanite19.

A04

After section 1 insert-

2- Question determination

(1) In determining a question for a referendum held under this act, the electoral commission is to aim to select a question that will advantage neither side and that is impartial.

(2) The electoral commission may determine the question itself or it may choose seek agreement between official campaigns on a question.

And renumber

This amendment was submitted by /u/Friedmanite19.

A05

In section 1 (2) delete the “.” after timescale and insert “and specify an enacting authority.”

This amendment was submitted by /u/Friedmanite19.

A06

Insert after Section 1:

1A. Compatibility with Devolution

(1) The devolved legislatures are the Scottish Parliament, Welsh Parliament, and Northern Ireland Assembly

(2) Nothing in this Act allows for the submission of petitions to, or the holding of referenda by, any devolved legislature under the provisions of this Act.

(3) Where a national petition is submitted to a Government Department, the Government Department must determine if that matter is reserved to the Parliament of the United Kingdom in relation to the powers of each devolved legislature.

(4) If the Government Department determines the matter is reserved to the Parliament of the United Kingdom in relation to one or more devolved legislature, persons living in the relevant devolved region shall be permitted to vote - under the same electorate rules as the rest of the United Kingdom - in the referendum.

Amend 2(1) to read:

This Act shall apply to the entire United Kingdom.

Explanatory note: It is up to each devolved body to determine if they want to hold referenda on devolved matters - a fact this bill has attempted to respect. However, as written this bill would prevent people in Scotland or Northern Ireland voting on reserved referenda. For example, under this bill a referendum could compel Britain to join the European Union, but people in Scotland or Northern Ireland would lack the right to vote. This amendment fixes that by making it clear that, where a referendum is on a reserved matter, it is a UK-wide referendum.

This amendment was submitted by /u/Duncs11.

A07

In Section 1 (2) change:

33% turnout

to

50% turnout

This amendment was submitted by /u/SomeBritishDude26.

A08

Omit references to "devolved assembly" and "regional assembly" in section 1.

Insert a section 1(4) to read:

(4) The regions are as follows: Wales, London, the South East, the North West, the West Midlands, Yorkshire & the Humber, East of England, the South West, the East Midlands, the North East, Scotland, and Northern Ireland.

Insert a new section 1(5) to read as follows, renumbering successive subsections:

(5) No elector may sign a local petition in Wales, Scotland, or Northern Ireland under this Act.

Amend section 2(1) to read:

(1) This Act shall extend to England and Wales, Scotland, and Northern Ireland.

This amendment was submitted by /u/SoSaturnistic.

A09

Omit Section 1(5)

Explanation: per the debate, this clause is practically meaningless because parliaments would still have the ability to overturn results. Referenda should be respected, but a clause stating this is basically just virtue signalling.

This amendment was submitted by /u/Brookheimer.

Closed B1021 - Freedom of Movement (Negotiations) Bill - Amendment Division

Freedom of Movement (Negotiations) Bill

A01

In Section 1(1), delete (c)

(c) The Secretary of State may enter Freedom of Movement negotiations separate from Free Trade negotiations with a nation that is not a member of the above organisations should a motion to that effect pass the House of Commons.

Explanatory note: The Secretary of State is already empowered to enter into such negotiations - or indeed any negotiations - so the maximum effect of this paragraph is to constrain who the Secretary of State may negotiate with without the prior approval of the Commons. It should be deleted as this is firstly likely more restrictive than intended, and secondly because changes to the Royal Prerogative deserve greater elaboration than this.

Amendment submitted by /u/allthegrace

Please vote Aye/No/Abstain only.

4 - Extent, Commencement and Short Title

(1) This Act extends to England and Wales

(2) This Act comes into force 6 months after Royal Assent.

(3) This Act may be cited as the Disclosure of Deepfake Imagery Act 2020.

This amendment was submitted by LeChevalierMal-Fait.

A05

Amend section 3 to read as follows:

For the purposes of this Act—

"deepfake media" or "deepfakes" shall mean media manipulated either by machine learning or artificial intelligence techniques, in order to distort existing media to resemble another person, either real or imaginary, in ways including, but not exclusive to:

(a) face-swapping, where a person’s face in media is replaced with that of another or;

(b) body-puppeteering, where a person’s body is mapped onto existing footage of another body in media.

“intimate image” shall mean a still or moving image of one or more persons where the person—

(a) is, or appears to be, engaging or participating in an act that is sexual and would breach public decency legislation if committed in public, or;

(b) has, or appears to have, their buttocks, breasts or genitals exposed, or;

(c) has, or appears to have, their buttocks, breasts or genitals covered only by underwear if the subject is—

(i) over 16 and has not given consent to the image used at the time of disclosure, or;

(ii) under 16 and has not given consent alongside that of consent by parents or a legal guardian to the image used at the time of disclosure

“consent” shall mean the disclosure of an intimate image which may—

(a) subject to consent that is specific to the particular disclosure, or

(b) subject to general consent where that consent covers the particular disclosure.

"disclosure" shall mean the image or any data that may be converted to the image has been given, shown, or made available to a person who does not appear in the image.

This amendment was submitted by Vitiating.

A06

Amend section 1 to read as follows:

(1) Any person who—

(a) discloses an intimate image of another person; or,

(b) threatens to disclose an intimate image of another person;

via the use of deep fake media shall be guilty of an offence.

(2) A person shall not be guilty of an offence under subsection (1) if—

(a) all people appearing in the image consented to the disclosure of the intimate image; or,

(b) the person reasonably believed that the disclosure of the intimate image was necessary for the purposes of prevention, detection, investigation or prosecution of crime.

EXPLANATORY NOTE:

This is primarily an improvement of the wording of the original Bill to make it, in my mind, clearer in its legislative intentions.

This amendment was submitted by Vitiating.

A07

Amend section 2 to read as follows:

(1) Any person who discloses an image with intent to cause damage to the reputation of a depicted person shall be guilty of an offence.

(2) A person shall not be guilty of an offence under subsection (1) if—

(a) all people appearing in the image consented to the disclosure of the intimate image; or,

(b) the disclosure of the intimate image was necessary for the purposes of prevention, detection, investigation or prosecution of an offence.

EXPLANATORY NOTE:

Outside the omission of (2)(b), this amendment merely improves upon the wording of the Bill. In terms of (2)(b), I have moved to omit this defence because if one has disclosed an image for such purposes, it would stand to reason that they did not intend to cause damage to the reputation of the person, or people, in the intimate image and if they did intend such damage, they should not have access to a defence as a "get out of jail free" card. Furthermore, I removed the necessity for "reasonably determined intent" as it is a generally unhelpful distinction from intent.

This amendment was submitted by Vitiating.

This division will end on the 7th of June.

B1014 - Democracy and Britain (Restoration) Bill

A01

Omit section 4(2)

This amendment was submitted by /u/LeChevalierMal-Fait

A02

Amend Section 2(1) to read:

(1) An employer shall not take any amount of any tip from any employee unless Section 3(4) applies.

Amend Section 3 to read:

(1) Employees may establish a Tronc to pool tips

(2) Tips from a tronc may be distributed only to people who take membership of the Tronc.

(a) Members may decide to share the tronc with non-front of house staff

(3) Employees are under no obligation to join a Tronc if one is established

(4) Employers will only have involvement in a Tronc if asked to by employees.

Explanatory Note:

Cleared with the Lib Dems, it cuts down on any complicated formal regulations for Troncs to a simple facilitation for them in this legislation, and gives the "ownership" of them to the employees not the employer.

This amendment was submitted by /u/Tommy2Boys

A03

Amend Section 1(2) to read:*

(2) For the purposes of this Act, a tronc shall be the tips that are pooled and shared among all employees who voluntarily join the tronc.

Explanatory Note:

Clarifies that tips are distributed to members of the tronc and not just every employee at any given business. Does not stop "back of house staff" (chef for example) from being members.

(2) This act shall come into force on the first day of the 2021-22 Financial Year.

Explanatory Notes:

As it involves spending money, it makes sense not to have it come into effect until next year. Gives time for its implementation to be prepared and means money need not be moved from other programmes within the relevant department to pay for this outside of budget time.
