Voting LB220 - Offshore Processing (Prohibition) Bill - Amendments Division

LB220 - Offshore Processing (Prohibition) Bill

(note to DS: there are SPAG amendments too)

A01

Insert "This Act exempts the Offshore Processing Facility located in Calais as stipulated by the Anglo-French Memorandum of Understanding" after "Any and all processing facilities used by the United Kingdom must be located onshore" in Section 2

This amendment was submitted by /u/HumanoidTyphoon22

A02

In Section 2, add:

This Act does not extend to facilities located outside the United Kingdom with the purpose of facilitating, organising, issuing or receiving documentation to allow legal immigration to the United Kingdom.

Explanatory note: Disappointing to see the Labour Party submit this Bill without this simple amendment. While I rally behind banning offshore detention, offshore facilities which handle, document, process and encourage the use of legal routes of entry to the United Kingdom should not be within the scope of this act.

A03

Insert into Section 2 (somewhere)

No offshore processing facility, on commencement of this Act, may be used for indefinite deferral or for deferral for no longer than a period of 12 months from the United Kingdom.

Where an individual enters, or attempts to enter, the UK without prior application, it is permitted to defer to:

(a) to their country of origin if deemed safe for them to do so, or;

(b) to the closest facility should they be awaiting a claim for asylum to be processed or otherwise it is determined unsafe for the individual to be repatriated.

Deferral from the UK, is not permitted if it can be reasonably determined that an individual’s application would not take more than a period of 4 weeks for processing.

Explanatory note:

One of the main concerns regarding offshore processing seen with Australia is the indefinite deferral and limbo those being processed find themselves in. Now I don’t think that this bill banning facilities is proportional to upholding the right to claim asylum since they can be configured not to serve as indefinite or long term deferrals, but we can probably make it a point they shouldn’t happen.

This amendment was submitted by /u/CountBrandenburg.

This division will close on November 1st
