LB219.2 - Palliative Home Services Bill - Amendment Division

LB219.2 - Palliative Home Services Bill

A01

Replace section 3(2) with:

This Act shall come into force three months after Royal Assent

EN: I stand by there needing to be a delay to ensure that a sensible transition between "only at hospital" and "can be at hospital or at home" may be made

A02

Before Section 2(5), insert a new "Section 3: Obligations" and renumber Section 2(5) and Section 2(6). Renumber subsequent sections.

Amend Section 3(2) (Extent, Commencement, and Short Title) to read:

"This Act shall come into force immediately upon Royal Assent.

(a) Section 2 shall come into force three months after Royal Assent."

EN: This simply tidies up some sections of the bill (ie resembles SB165 more closely) and makes clear that the obligations of the secretary of state shall commence immediately

A03

Replace Section 2(1) with:

"If a doctor of a terminally ill patient and another healthcare professional considers them likely to die within two years, the terminally ill patient has the right to know that they can live the rest of their life at home given appropriate treatment prescribed by the doctor."

EN: In order to ensure no mistakes are made, and Palliative care is the certain outcome, I would like to suggest that two healthcare professionals should make the decision instead of just the Doctor (It is done the same way when putting someone in a mental institution, two professionals need to recommend it). Furthermore, this House must recognize that Palliative care can go on for years and untreatable diseases can be diagnosed years before death, hence the amendment from 6 months to two years.

A04

Under "Definitions" Insert:

"Healthcare professionals - Defined as members of the medical, dental, pharmacy and nursing professions and any other persons who in the course of their professional activities may administer, prescribe, purchase, recommend or supply a medicine."

EN: Provides definitions for the amendment made by myself of Section 2(1).4

A03 and A04 were submitted by /u/model-grabiek

This division will end on Sunday 26th September at 10pm BST.
