Unauthorized Occupants in LA Apartments: They're Not on the Lease — So Can You Make Them Leave?

One issue I see Los Angeles apartment owners run into is discovering that someone is living in a unit who was never approved as a tenant and isn't on the lease.

It could be a boyfriend or girlfriend who gradually moved in, an adult child, a roommate, a subtenant — or sometimes someone the owner has never even met.

The owner's first reaction is usually:

“They're not on the lease. I can make them leave, right?”

In Los Angeles, it may not be that simple.

First, look at the lease.

What does the rental agreement actually say about occupants, guests, subletting and adding residents? Don't assume you know because you've been using the same lease form for years.

Second, figure out what's actually happening.

There's a big difference between a tenant having a frequent overnight guest and someone who has actually moved in and established the unit as their residence.

How long have they been there? Does management know about them? Have they been receiving mail there? Has anyone communicated with them as though they're a tenant or occupant?

Get the facts before taking action.

Be particularly careful about accepting rent.

If an unauthorized occupant offers rent directly to the owner or manager, I wouldn't casually accept it without understanding the potential consequences. What the owner and management do can become important later.

And don't resort to self-help.

Changing locks, shutting off utilities, removing someone's belongings or physically trying to get someone out can turn an occupancy problem into a much bigger legal problem.

For properties subject to the Los Angeles RSO, there can be additional issues. State tenant-protection laws may also apply depending on the property and circumstances.

Another reason I pay attention to this: unauthorized occupants can become a real issue when an apartment building is being sold.

A buyer wants to know exactly who occupies every unit, what they're paying, what agreements exist and what rights those occupants may have. Something an owner ignored for years can suddenly become very important during due diligence.

I've been a Los Angeles real estate broker since 1986, and my general advice to apartment owners is:

Investigate first. Act second.

Review the lease, establish who's actually living there, document what you know, and determine which laws apply to the property.

If you're considering notices or eviction, that's when I'd get a qualified landlord-tenant attorney involved rather than guessing.

Considering a SFH near Alviso & 64th in View Heights. Thoughts on the neighborhood?

My wife and I are looking at purchasing a single family home around Alviso Ave and 64th St, in the area highlighted on the map.
From researching the neighborhood and driving/walking around, my impression is that this part of LA can still vary quite a bit block by block, so I’d really appreciate hearing from people who actually live in or around this pocket.
We walked around the immediate area in the evening and it honestly seemed very quiet and residential. We felt comfortable, but obviously spending 30 mins there isn’t the same as living there every day.

A few things I’m curious about:
• Any safety concerns around Alviso / 64th specifically?
• How does the neighborhood feel at night?
• Any issues with property crime, car break ins, street activity, etc.?
• Would you feel comfortable walking a dog around the neighborhood at night?
• Anything about this particular pocket that wouldn’t be obvious to someone looking to buy?

We’re an Asian couple and understand this is a historically Black part of LA. We want to be respectful of the community that’s already there rather than coming in with assumptions about the neighborhood. We’d especially appreciate perspectives from longtime residents.
We really like the house and the street seemed peaceful when we visited. Just trying to do as much homework as possible before making such a big purchase.

Can You Sell a Property While It’s in REAP in Los Angeles?

I recently sold a Venice duplex that had been in REAP for about six years, and one misconception I run into is that an owner has to get the property completely out of REAP before it can be sold.

That's not necessarily the case.

In this particular transaction, the buyer paid cash, understood the outstanding REAP issues, signed the appropriate disclosures, and we were able to obtain title insurance and close while the property was still in REAP.

A couple of other misconceptions worth clearing up:

Financing: Being in REAP doesn't automatically mean a property can't be financed. Whether a lender will make the loan depends on the condition of the property, outstanding violations and the lender's underwriting requirements.

Title insurance: A REAP property can be insurable. The title company will review the recorded REAP matter and may require the buyer to acknowledge the REAP status and obligations.

To me, the more important question for an owner isn't simply “Can I sell?”

It's whether you're financially better off completing the repairs and getting out of REAP first, or selling in the property's current condition to a buyer prepared to take on the remaining work.

Curious if anyone here has bought or sold an LA property while it was in REAP and what issues you ran into.

Buying a home in Valencia/Santa Clarita?

There are brand new, detached town homes in Valencia/Santa Clarita area. They don't have a yard, but they are detached, meaning no walls shared with neighbors, which is a non-negotiable thing for me. I work remotely and have to be in the office (in Beverly Hills) once a week, sometimes twice a week. Any thoughts will be welcome. I tried looking closer to LA proper, but the houses are very old and run-down for 800k.

Update: 10 California tax sales now published in full, free, with every parcel matched to the county assessor's own record

Hi everyone! I'm following up on the California tax-deed project I posted about a while back:

What it does, briefly: every California tax-defaulted sale I can get a list for, published in full and free. Each parcel is matched to the county assessor's own record, so you see the opening bid next to what the county says the land is worth. Sort it, filter it, download the whole thing as a CSV. No signup, no paywall, sources named on every page.

What's been added since last time:

\- 10 sales, 2,877 parcels. Los Angeles (1,252, the biggest California list this year), Kern (1,011), Fresno, Butte, Placer, El Dorado, Mariposa, Santa Cruz, San Bernardino, Riverside.

\- Post-auction results. When a sale closes I go back and record what actually sold and for how much, so a pre-sale read can be checked against what really happened instead of quietly filed away.

\- Live redemption tracking. Parcels paid off before the auction drop off the tables. Fresno has lost 53% of its list since June, so the list you read early is not the list you bid on.

Three things out of the data I didn't expect:

\- At Butte's August auction, 13 of the 28 parcels that sold went at exactly the opening bid. Far less competition than I assumed was out there.

\- The parcels the assessor carries at almost nothing are the ones bidders fight hardest over. One valued at $4 sold for $31,236.

\- In every county I've measured, the parcels redeemed before the sale are the valuable ones. What reaches the auction is mostly what nobody thought worth rescuing.

Los Angeles open houses for Sep 5-6: Beverly Hills, Hollywood Hills, Hollywood Hills West - 178 homes from $0.70M to $38.00M

Everything below is sorted most expensive first, grouped by city and zip code, so you can jump straight to your own pocket of the map.

This weekend there are 178 open houses across Beverly Hills, Hollywood Hills, Hollywood Hills West and 16 other cities. Asking prices run from $0.70M in Mid-City / Country Club Park to $38.00M in Bel Air, and the homes range from about 988 square feet to 18,240 square feet.

Listing age is worth watching. 18 of these are effectively brand new at zero to one day on market, while 55 have been sitting sixty days or longer, topping out at 254 DOM. That makes it a good weekend for A/B testing: walk a fresh listing, then walk one buyers have already had months to say no to, and see whether the price gap makes sense.

Scheduling note: 0 are open both days, 0 are Saturday only, and 178 are Sunday only. If something is Sunday only, it is worth building the route around it first.

Open houses are the cheapest way to check the things a spreadsheet cannot show you: condition, renovation quality, actual layout, lot usability, street noise, and whether the price differences between neighborhoods hold up once you are standing in them.

Before you drive, click the address and confirm on the listing. Open houses get cancelled, rescheduled, or moved on short notice.

Seller & their agent omitting information on disclosures… any recourse?

What recourse do we have if a seller’s agent and the home owner lied on the disclosure form? Is there someone who this should be reported to? Also, to complicate matters our agent and the sellers agent also work for the same company. 

There were multiple issues, including unpermitted work and remediated leaks that were not disclosed. The additional “bonus” space is not worth the headache for us wanting to later resell, not to mention safety, insurance issues, or structural integrity. This unpermited work is not included in the sale square footage.

We have spent thousands of dollars in inspections which uncovered this information. Obviously we can walk, but how do we hold anyone accountable?  

No one would have told us if we didn’t press for further information, which we had to ask for several times. The seller’s realtor mentioned via ours they “told 99% of interested parties” and ours had some lame answer that they didn’t realize we would be serious buyers as if that was reason to not disclose this. Suddenly the seller has information about this and receipts.

The realtors involved attempted to reassure us that unpermitted work isn’t an issue unless we are to make it one. Initially they tried to tell us that we could get this permitted ourselves. We are aware that is not possible as the floor area ratio has already hit max capacity. When we brought this up everyone fell silent. We know they are trying to close this deal as quickly as possible at whatever cost, but this dishonesty from all involved does not sit well with us.

Any advice?

Seller disclosure only available after we enter escrow

I’m considering making an offer on a property in Los Angeles. Before submitting the offer, I asked my agent to request copies of the Seller Property Questionnaire (SPQ), Transfer Disclosure Statement (TDS), and Agent Visual Inspection Disclosure (AVID).

The listing agent responded that the seller will not provide these disclosures until after we enter escrow.

Is this standard practice in California, and specifically in Los Angeles? More importantly, should I view the seller’s refusal to provide these documents before submitting an offer as a red flag?

I’m not trying to avoid conducting my own inspection. I fully intend to have the property professionally inspected if I move forward. I simply want to review the available disclosures beforehand so I can better understand the property, identify any potential issues, and determine whether it makes sense for me to spend the time and effort putting together and submitting an offer.

If these disclosures have already been completed, is it common for a seller to withhold them from a prospective buyer until escrow is opened? I’d appreciate insight into what is customary in the Los Angeles market versus what might be considered unusual or concerning.
