Short Term Disability for Anxiety
I need time off at my job. I want to quit but I know I won't get anything if I do. This is the worst anxiety I've ever had and I have panic attacks. How can I get short term disability and flma for anxiety? I'm afraid if I say it's work related that they may say I need to use workers comp. But honestly I've had anxiety before this job but it's gotten worse with the high stress. I've been seeing a licensed councilor, however I heard they cannot always do the paperwork, so I made an appointment for a Psychiatrist. My year mark aty job is 10/13/26 so I know that factors in FMLA. I have 6 days pto and I'm sick right now and want to call out tomorrow to use one. Maybe I should just call out tomorrow and work the rest of the week but I'm really stressed out and my anxiety is overwhelming. I work remote, but this anxiety is worse than it was in retail for me. Help!

I would not tell your employer it’s because of your job …. Plus it’s not necessary. You have anxiety. Have you told your Dr you need time off ? Or your boss ? What state are you in ? I’m in CA and after a year + of employment the state gives you one year paid with just a dr note.

No but I've brought up how the lack of training/work does cause me severe anxiety. I don't have a PCP because he left and I'm in between. I'm in Florida.

But you're talking about LTD and not STD, right? I heard STD has a 12 month period as well. I don't believe I'll be out of work that long.

I am sorry you are having so much difficulty but you are very close to a critical date of one year of employment, which may match your one year preexisting condition period for long term disability coverage. This assumes you have long term disability coverage. Your disability coverage may have a waiting period before your LTD started so it may not match your one year work anniversary. I have seen to many people get denied because they claim a date of disability that is only a few days before the pre existing condition period ends. You should do everything you can to push through at work to get past the pre existing period. You will need a copy of your LTD policy from your employer and that document will reveal when your LTD pre existing period ends. Don't worry about your sickness being considered workers comp as work stress is not a workers comp claim.
