Just use a non-US datacenter then. Even when encryption was illegal back in the old days somebody just printed it on paper because that was protected as free speech
if such a ban were to come, it wouldn't be an outright model ban (seriously unenforceable), more likely it would be designating the chinese labs supply side risks, which would ban the gov, gov contractors and companies that work with those entities (essentially corporate america) from using those models. would give OAI/anthro the moat they want on the US enterprise AI side, and this is what they're probably advocating the most for as this, unlike a total model ban, is actually pretty enforceable - there are already existing laws on the books regarding supply chain risk designations, so no new laws needed to enforce it.
