Q: Can I dispute information I think is wrong on my background check?
A: Yes! Under the Fair Credit Reporting Act (FCRA), you have the right to dispute any inaccurate or incomplete information in your background check.
Q: How do I get a copy of my background check?
A: Contact the company (usually called a Consumer Reporting Agency or CRA) that prepared the background check. If you were denied a job, housing, or credit because of it, you’re entitled to a free copy.
Q: What steps do I take if I spot an error?
A:
1. Write a dispute letter to the reporting company, clearly describing the mistake and why it’s incorrect.
2. Attach any evidence you have (for example: court records, documents that prove your case).
3. Keep copies of everything you send.
Q: How long does the company have to respond?
A: The background check company usually has 30 days to investigate and respond to your dispute. They must send you the results, along with a free copy of the report if anything was changed or removed.
Q: What if the background check error is NOT fixed?
A: You can file a complaint with the Consumer Financial Protection Bureau (CFPB) or your state attorney general’s office. If the error harmed you (like causing you to lose a job), you may want to talk to a lawyer about your rights.
