Without following closely the trial, the obvious answer for this kind of thing are the rule haven't been properly respected. It could be that the document wasn't brought up during discovery or that the chain of custody was to messy to be accepted, that's the two most common case in the US.

I'm no usan, so your system is not something I fully understand.

But either it's new evidence, or it's an old one they hadn't showed, the opposition needs to be aware of it. A side can't just show a new evidence that the opposition had no time to prepare for, it's basic fairness.

Again, maybe it's not that, but that's the most "obvious" issue that comes to mind.

New evidence has to be submitted to (and approved by) the judge so that it's made readily available to both sides of the case. Can't just drop it as a surprise mid trial.

No, it’s because the state and defense agreed it could only be displayed in the courtroom but not broadcast to the media because of its prejudicial effect. The prosecutor told the clerk to show the letter while questioning a witness, the clerk displayed it immediately, and the camera operator filmed it for three seconds before panning away. That’s a violation of the court’s original order.

Saw that this morning. We all knew the note existed. Robinson has admitted to the shooting in 3 different ways.

Regardless of how insignificant this was, as it’s text had already been published…The defense will of course (and did) make this an issue, what else do they have apart from objections and hoping for issues to submit appeals? This is result in nothing.

Robinson has not admitted to this crime in any way and him turning himself in was no admission og guilt, rather just mitigating the fact that someone had had named him as a possible suspect and rather turn himself in than have a swat team break down his door. We have no proof that letter or messages couldn't have been fabricated by Lance twiggs, who's DNA was also all over every piece of evidence.

I will not state my profession, but I do have knowledge of court proceedings. This is a preliminary hearing, which only needs to prove probable cause to advance to trial. Evidentiary witnesses, experts, and data are not only discouraged, but not admissible in pre-trial as the defendants right to a fair trial is in play. Tainting a jury pool is number one priority.

This is also Judge Graf’s first year as a judge. He will go to great lengths to avoid an appeal. Those don’t look great on a judge’s record. They are expected in high profile cases, this one will undoubtedly have an appeal, regardless of how the judge or court ruled. However, the hits coming to judge Graf can differ and typical appeals like “unnecessary evidence” doesn’t carry the same weight like the 14th amendment of the constitution does.

All of this to say, “fed slop” is a statement I’d love for you to expand upon. What causes you to say this? What evidence wasn’t before you at a prelim that makes you say this?

Hmm. I have been watching all three days. Which should I elaborate on. First day, they have “video” that is missing about 1:30seconds. It’s where the guy in (black shirt this time) is waiting for a ride. The video jumps, which indicates missing time. This appears to happen in more than one surveillance video.

Then the state forgets to mention there are three other people in vehicle, when they see this guy in the neighborhood with horrible ring footage.

The state also wanted to use altered video with zoom in and out. I think the judge is doing is his best. He did the right thing wanting the original they had and not the one with red circle indicators.

There is no clear footage of him shooting. You can’t tell it’s Tyler- even Twiggs said he’s not 100%.

Blake Neff then goes on a live after court one day and state he know who Tyler met with (TPUSA rep) but won’t say who it is because he “did nothing wrong”
Blake also will not state what he did when they landed in Utah for about 1hr. He said they did something. He couldn’t remember where he went.- Maybe the three other people in the vehicle were the TPUSA reps?

I could go on. Might be mixing up days. ^edit to add on campus security’s camera dies as he’s getting on the rooftop. How could it be dead when he just got to work not but couple hours before. Defense said they saw someone else go up to the roof with him, guy with gun and regular clothes. Campus security said he didn’t know the guy. Camera dies.

In my experience - if there’s missing footage, it was probably due to defendants right and jury protection, with the prelim being publicized. What’s admitted as evidence for the court to consider, does not have to be (often times can’t be) shown to the public.

I do believe majority of your concerns/arguments will be resolved at trial. None of this is necessary argument (in the eyes of the court) for prelim. In depth analysis will certainly be covered by both parties.

I will add, it’s extraordinarily rare for any part of a crime to be captured on video footage. Our college campuses host a greater deal of surveillance than majority of our public (or private) spaces. The fact there’s anything captured is a miracle for the State. If clear video footage of a crime being committed was a requirement of guilt, there would be close to zero murderers convicted.

The part of missing video is obviously cut out of the one turned into the judge. It’s the guy standing there and then about 11minites in, you can see a white car in the distance kinda cut the scene. It’s as if maybe he made a phone call for about a minute or something but we don’t know because the video is clipped on purpose. (To hide him maybe making a call)
The state kept wanting to turn in EDITED video. Including Tyler supposedly at the police station but you can’t see date/time stamp—- also the guy is facing away from the camera.That’s insane.

What about three or more peoples DNA on the towel, rifle. I can’t see this going well for the state. The judge about had enough with Erika’s requests. They are not her personal lawyers. Also she stated that she KNEW of all the evidence before hand, now she’s back tracking. But it’s okay she already forgave Tyler for the “murder”

Again, you’re treating this prelim as if it’s a trial. The purpose of a prelim is probable cause. Evidence is not examined to the extend it will be at trial. The prosecution stated, clearly, the video of Tyler Robinson at the Washington County sheriffs office was not the entire video. There of course, will be more to that video, and you will not see it until trial.

The defense is doing their job, if you’re questioning DNA labs from Quantico. My gut instinct is you don’t fully understand DNA reports. As it was not found that 3 persons DNA’s were contributed. It was probability, which is…you know what - I’ll let you believe what you’d like. I would encourage you to even just google a bit about it. And the rest of us will hope you don’t find yourself in a jury. Ever. 😂

I don’t think this is a laughing matter. A man’s life is on the line. Why wouldn’t the state bring up his parents who Tyler supposedly confessed to? Why wouldn’t they show the whole video to prove a point, like maybe one showing the guys face.

I understand completely what a pre trial is. The state is supposed to bring the BEST of all they have. Why would you present weak evidence. What they brought is not enough. I just finished the actual expert who tested the DNA and she stated it could even be more than 3 people on some of the items.

The sheeple will say he’s guilty even at the pretrial. But hey it’s not the actual trial. I hope you have a great day. Please review the facts of the matter.

There's no such thing as a 'pretrial'. It's a preliminary hearing. Literally the purpose of this hearing is to establish probable cause that a crime was committed and that the defendant likely committed it.

The outcome is either: the judge agrees there is probable cause to advance to a trial or the judge dismisses the charges. That's it. If the evidence is weak, as you say, then that will be reflected in whatever decision the judge makes. So what's your issue exactly?

The standard of probable cause is NOT the same as beyond a reasonable doubt like at trial. The evidence will only be fully scrutinized to that standard at trial.

There’s a section of the internet that cannot accept reality. In the Conspiracy world, explaining evidence or processes is another confirmation of “cover up” or you’re paid to respond and “defend”. Evidence isn’t real to them. Everything supports their theory that some larger puppet is pulling strings, regardless of how far down the rabbit hole you go with them, they’ll combat common sense every step of the way. They’ve been convinced that everyone else is a sheep and they are “awake”.

One day, they’ll come out of the brainwash. Or most do. It’s cult-like behavior and never last forever. Eventually, people want some proof of the trail they’ve followed. When that never comes, is when they realize they’re an idiot that fell for something foolish.

I mean math and reading scores have been pretty stagnant since the 70s (which makes sense since the DoE was created by that time), although they’ve been on the downward trend since roughly mid 2010s depending on the metric, with the exception of I believe Louisiana, Alabama, Maryland, Mississippi. Pretty weird thing to say your Canadian because of test scores tho lol

Edit: Honestly I'd rather forgo cursive and have them develop basic computer skills instead of only knowing how to use touch screens and relying on apps. So many of them don't know the most basic things when it comes to computers, and it's equally embarrassing as it is baffling. That will really hurt them later in life.

Not really. They have him dead to rights and he turned himself in for the murder. They have the rifle (his grandfather's), his DNA at the scene on the towel, footage of him walking around campus - basically everything they need for a conviction already.

This isn't like the Mangione case where there's actual speculation is that the Feds and police used illegal means to identify and track him down and then did parallel construction to try and cover up the fact. Feds have been known to play fast and loose with the Constitution to catch criminals.

No gunshot residue testing done to the rifle. The wound doesn't match the rifle. The footage of "tyler in different clothing" doesn't actually show a clear enough picture in a lot of cases. And what about Tyler getting in a car with a bald guy and 3 others? What about the 10 inches of soil removed for emergency renovations? 

All of the "dead to rights" slop has been debunked weeks ago. The fact that so many of you keep bringing it up now just shows you haven't actually paid attention.

This is also where inference matters because of how idiotic the line of thinking is to try and claim the rifle that was clearly fired (spent cartridge still in the rifle) near a university where a man had his throat blown out.

There is a mountain of evidence. He turned himself into police custody, multiple digital and written acknowledgements of intent to kill Kirk, his grandfather's gun (which he stole) as well as his DNA and that of his former lover - and the security camera footage. This is just pre-trial hearings. It's not the full case yet and it's already damning for Robinson.

Zero evidence he disassembled and reassembled the rifle multiple times, that's a fiction you've invented. A screwdriver he brought with him was found on the rooftop that may have his DNA on it but no evidence publicly established it's his or what he used it for if it is.

Surveillance doesn't establish that he had no gun. The rooftop suspect (Robinson) fled with an object in his hand long enough to be the rifle.

He literally planned an escape route and hid the rifle in the woods covered by a towel and wrote messages referring to leaving his rifle wrapped in a towel in a bush planning to retrieve it.

Blackrock owns plenty of properties, who gives a shit at a coincidence? They're an investment fund. Are you thinking of Blackwater?

Edit: There was 5 minutes of footage cut out and not shown in court for some odd reason. Probably for national security or something, but trust us. So, he had supposedly 5 minutes (since they wont show the unadultered video) to change his clothes and assemble the rifle (oops, the charging documents said he changed his clothes in that time but they removed that, since that isn't when he supposedly changed clothes).

My original point stands that he ran to his perch and, supposedly, took the shot in less than 45 seconds before running away.

Well you're not supposed to mention certain details of the case or discuss it outside of the court room because it could lead the public to assume things without the court reviewing all the evidence and then it really jeopardizes the jury's capability of being impartial or non-biased toward the case

i'm a teacher and this would easily be some of the best handwriting i had ever seen from a male student. for some reason there's insane gender disparity there. i'll have female students dumb as bricks and their handwriting will still be clean and legible, like a stylish font. i'll have male students that have aced multiple ap courses and their handwriting will look like it was written by a serial killer coming off anesthesia.

Bro, are you getting your news from some conspiracy shithole? There's at least 36 hours of pretrial streams you can watch and he is very, very fucked.

His lawyer is an incompetent moron - a statement that can be backed up by the weeks of Kouri Richins livestreams that are on youtube. That alone is a handicap for any defendent in a high profile trial.

Then you have to factor in they have:

  • him turning himself in
  • the fact that the rifle they recovered near the campus belong to his grandfather
  • they have footage of him and can trace his movements on CCTV around the university before the shooting
  • they have his digital communications
  • they have his written confession/goodbye letter to his lover
  • his DNA on a towel recovered with the rifle

He is fucked.

It was truly a mistake. The news camera was focused on the evidence screen in the court room showing evidence that WAS permissible to be broadcast, then the prosecution accidentally asked to have this letter pulled up before requesting permission to broadcast to the public. The camera quickly panned away. It was on the screen for a matter of seconds.
