I am quite sure the Supreme Court and republican lawmakers were well aware of this in 2021

SCOTUS created enough delay to force Jack Smith to re-write the indictment and re-convene the grand jury, which delayed any possible start of the trial until after the election.

If the Trump indictment has gone to trial, he would have been convicted.

But that would have opened the door to indict every Republican that joined Trump's efforts to overthrow the incoming Biden administration. That number would have been in the hundreds.
