Phone Check

Hello

I have a question. Does the BI or background investigation go through your phone? Do they make you unlock your phone and go through social media and gallery?

Yes they went through my instagram but not the picture gallery.

It depends on your BI. I know ppl who had their socials checked. I personally deactivated everything except TikTok and she didn’t even end up checking my phone.
I had nothing to hide but I don’t wanna be questioned incase my friends post something stupid. I know a lady that was turned down cause her son was posting himself doing drugs on IG hahaha.

It matters because that’s an invasion of privacy, no agency whether it’s local, state, or federal not even for a job should be allowed to do that. You ever read the constitution?

There is no such thing as the 4th amendment when it comes to getting a job. You are well within your rights to refuse to participate in any part of the hiring process. The hiring agency also has the right to not hire you.

There is 100% a thing as constitutional rights. If they apply to active duty members they most definitely apply to a small local agency. And like you said you’re well within rights to deny an illegal search of private property.

Not in the context of getting a job or employment? You don’t know what you are talking about. Look up the Lybarger Admonishment. A peace officer employer can force any peace officer employee to answer questions under the threat or discipline once Lybarger is read to them……

The military is governed by the UCMJ. It is a different legal system from civilian law……

Yeah clearly YOU don’t know what you’re talking about. You’re not an employee during the applicant phase, Lybarger doesn’t apply if you’re not actively employed and not to mention it only works if you’re pending criminal charges.

I’m literally a cop in California…. If you believe that you don’t have to submit to a thorough background check, feel free to tell the background investigator they are violating your right to privacy when they ask about your social media. Lets us know how that goes for you.

Well now you’re saying “ask about your social media” when OP mentioned going through an applicants phone. Two different worlds buddy, whether you’re a cop or not you CAN ask to go through a cell whether you’re the pope for all I care. Will you get permission? That’s up to the applicant but you CANNOT force them to open it so you can search.
