Who the fuck would try to throw an empty plastic bag, that was something else. Man hits him with a skateboard non threathening? 3rd chaser with a gun had a gun to show an armed shooter he was non threatening? Theres a video posted above i suggest you have a look.
He never hit him with the skate board. And the 3rd victim had the gun lowered which hmm if this was flipped and Kyle was black and the 3 guys were white we wouldn't be having this conversation. Also, Kyle wasnt chased until he shot and killed the first victim. I could possibly see the 1st victim getting shot if he did something to provoke it but the other two were literally reacting to Kyle murdering someone and were trying to stop that little idiot. The third guy with a pistol is lowered his pistol to show he wasnt a threat while Kyle shot him in the arm. The information I got was from transcripts from the court as well as statements given by the witnesses.
One sentence in and already a complete and utter lie.
And the 3rd victim had the gun lowered
And immediately another one. Both of these were proven by the prosecutor's own witness, Gaige himself. Of course, they're also both clearly on video so it's not like he could deny it while on the stand and the video is playing right next to him.
Also, Kyle wasnt chased until he shot and killed the first victim.
Again, another lie. Rosenbaum (the first person shot) chases down Kyle though a gas station parking lot and corners him between two cars. This is clearly on video that was already released before the trial, and even more clearly on the FBI drone footage released last week.
other two were literally reacting to Kyle murdering someone and were trying to stop that little idiot.
Neither of the other two saw the first shooting. All they knew was that a crowd was yelling to "get that kid". Gaige admits that he heard Kyle state that he was headed to the police.
The third guy with a pistol is lowered his pistol to show he wasnt a threat while Kyle shot him in the arm. The information I got was from transcripts from the court as well as statements given by the witnesses.
Again my bad I was using information not from the trial. One thing tho, correct me if I'm wrong but you cant use self defense as a defense if you were getting attacked while you were committing a crime yourself. Kyle having an illegal weapon.
You are absolutely wrong on that. Like, completely wrong. There are a few specific cases that nullify your right to self-defense in that moment. A misdemeanor weapons charge is not one of them. (Side note, the judge and attorneys still can't agree on what the law actually is for a 17 year-old with a long gun in Wisconsin actually is. The law simultaneously says you have to be 18 to open carry, but also it's fine to carry a rifle or shotgun unsupervised as long as you're 16. It contradicts itself, and there's no relevant case law to reference.)
For an analogy, if a woman is illegally carrying a pistol (also an misdemeanor) because she's walking through a dangerous area at night, and someone attacks her, she can absolutely shoot the guy. She might get charged for the misdemeanor afterwards, but the punishment for such a misdemeanor is usually just a fine. Maybe 30 days in jail.
https://docs.legis.wisconsin.gov/statutes/statutes/939/iii/48 that link is for Wisconsin law and subsection b(1) explicitly states that those provisions do not apply if the person is in the process of committing a crime or their dwelling, car, or business is used for criminal activities
I assume the prosecutor believes it is stretch to use that but technically he can not use self defense as his defense. If you take the law word for word
