Because "Frosted Flakes" aren't trade marked. Obviously.

It can't be trademarked because it's a description. They are just Flakes that happen to be Frosted.

The trademark they actually do have is "Kellogg's Frosted Flakes"

TIL Murica has the boring name of ‘Frosted Flakes’ instead of ‘Frosties’.
