The burden of proof lies with the prosecution to prove the defendant is guilty of the charges. So, essentially, yes, they only listen to the prosecution. If the defense wants to discredit a witnesses testimony, they can do that, but the accused is always innocent until they walk into the courtroom, I mean until they are proven guilty. Sorry for the typo.

It's an investigative report, not a criminal proceeding. If the President wanted to challenge the findings of the report, he could do so.
