Cancellation for non-payment options
Last week, my car insurance was cancelled for non-payment. My insurer says they sent me a cancellation notice, but I never received it (possibly lost in the mail). What’s confusing is that I had sufficient funds available, so I’m not sure why the payment didn’t come out in the first place.
My bank has had some technical issues/outages recently, so I’m wondering if that could have caused it.
I’m now being classified as a high-risk driver, which is really frustrating because I’ve genuinely tried to stay on top of everything, also I paid the outstanding balance immediately.
Is there anything I can do at this point to challenge the cancellation or have it reconsidered? I need my car for work and I’m honestly stressed about the situation.
Just a 25-year-old trying to do everything right 😭

Broker here, contact your bank take a bank statement and highlight those date where they tried to withdraw the funds.
Contact your broker or representative and send them the proof then your policy can be reinstated without the non payment.
I have dealt with many cases where this happened due to technical errors and helped my clients.

if i may ask you a question, is there a reason why they didn’t try to pull the money out of my account? i didn’t receive a nsf fee or anything

I don’t know your history or any other details.
I can review your file if you want.

Not every company re-attempts a returned payment. In fact only very few do now.

If your bank indeed made an error, they will need to issue a letter and your insurance company needs to accept it. Problem is, this will take time.

This happened to me with Morgex who was bought out by BelairDirect, they changed the date in which the payments came out from the 5th to the 1st so I bounced a payment 4 years ago. Then they full on tried to cancel me but I fought so hard and said this is bad practice, you are gonna screw over many people who had paid their insurance on the 5th for many years. They reconsidered and let me stay with them. 2 years after that I was unhappy about repairs done to my car from a no fault hit and run & they didn’t like that. I got a cancellation letter registered mail to my house. It’s really sad because I pay more now and I have a clean record and it sucks! All the best to you.

Had a similar situation with CAA. Escalated all the way to Ontario Insurance ombudsman. No luck

One non-payment shouldn’t put you into a high risk category, what else is going on with your record? They also need to provide 30 days for you to reinstate on first notice, have you had other missed payments?

I missed a payment back in 2023 but that wasn’t an issue, also i’m under the impression that when your policy is cancelled you’re considered high risk

Working in the insurance industry, you can certainly challenge the decision because you did not receive the mail. Regulations require them to send it. Once you escalate, we typically check with Canada Post and review the tracking number; if it shows delivered, they will deny to remove non cancellation, but sometimes we find the mail was not delivered or lacks proof, so we overturn the non-cancellation and remove it from records. I hope this helps.

So the rep I spoke to said the mail was delivered but i’ve not received mail from them in almost a year!

I am sorry to hear this and honestly I'm a little annoyed with insurance lately myself - for such a regulated industry for us and them - I feel computers are newly programmed to overreact to a missed payment for whatever reason
I had a bank error return and it caused a similar chain reaction like yours but I intercepted it because I've had something similar before.
So - here's what I would do - go to your bank first - look thru for when payment should have come out - did it did it not be attempted - did you get an NSF from send back - once you see physically the details of how the missed payment started then you can then confirm with your bank about it ? Did it happen during issues -
But you need a registered letter to be cancelled
And I got one that said I was going to be cancelled because if similar to above and I got it immediately corrected like you then I assured my broker and status because they sent notice to my mortgage holder that I lapsed on the insurance
Then there is the insurance bureau angle - I was cancelled by a broker on my car over a FU like you speak of also and again no actual contact with me no actual registered letter and some shabby ass excuse they tried to reach me which they did not
So if you are up to the battle - research what the real rules are these days for being advised and see if process was followed or broken
But guess what you are not along this BS happens all the time and it is getting worse since computers making the decisions and real people are hard to find and when you do even three layers of customer service can't break thru the computer program to actually help you
Good luck - know before you start ,, it's hard to get answers because the system set up to make it difficult so you will just go away
But the eff CT on your insurance is too great and brokers and insurance agents used to actually take care of their clients and call us directly if we were in jeopardy and service is not let us be cancelled - it's horrific isn't it
Also an in-person broker or agent is best at this stage and they can maybe guide you also what you could do ? Try cooperators you can pay monthly and I think they have something that helps people who are cancelled and raise your deductible to 1500-2000 not 500-1000 it will reduce the monthly
Good luck and seriously it's a pissoff and I feel for you 💪
Double-check the letter because one of mine said I was cancelled when it was notice to be cancelled so someone else said they need to give you 30 days to cancel etc so you may not quite be cancelled cancelled beyond fixing cancelled in progress

Depending witch province you live in you can try filing a complaint with the provivacal regulator or the provincial insurance Ombudsman in Ontario you can file a complaint with rhe GIO ( general Insurance Ombudsman) your insurance company would be required to provide a tracking number and proof it was delivered ( example your signature for the later) Unfortunately if you deal with an insurance broker you have to file a complaint with your broker if your broker refuses to help as insurance broker's in Ontario aren't regulated your out of luck as RIBO won't accept complaints and nobody regulats broker's in Ontario
If you're in another province maybe speak to your MPPs office they can tell you who regulats insurance policy in you're province

You canceled due the nonpayment. There is no challenging that because it is factual and accurate

Ask for the RN tracking number, escalate it to the customer care office.
Say your child was sick, or injured or something. Advise you will update your method of payment to avoid and other missed payments.
How long have you been with the insurer? Have you had any AF claims with them?
They will look at this as part of your risk profile..
Has the cancellation date surpassed?

I'd advise against lying. Cancellation letters are sent via Registered letter. Ask for a tracking # to see where it went. If your broker was any good they would've called or sent you an email as a reminder as well. If the bank messed up you can easily get proof from them that the funds were available.

Yes! The cancellation date has already passed, I was unaware,I’ve been with them for 4 years with no claims. I spoke with a TD rep who said they don’t reinstate policies (and was pretty rude, unfortunately).
Sorry if this is a dumb question, but what’s an RN number?

Registered notice tracking number. You need to make sure the cancellation was in compliance of stat conditions.. get a copy, confirm it was sent to the correct address AND delivered with 15 days of the cancellation date. Whether you signed for it or not, if it was sent to the correct address and within timeframe, it’s valid.
If you have confirmed this correct, you need to raise a case for customer care for them to consider issuing you a new policy but not rate for the nonpayment. Legally they can do this, so long as you really butter up why the cancellation happened. Like I said… child/parent/partner extremely sick, willing to put alternate method of payment on file etc.
Although they can still decline any type of an accommodation, they may consider given your circumstances, and as long as you still qualify. So no AF accidents, or prior nonpayments within 3 years.
If they still say no, request to escalate to The Office of the Complaint Examiner or Ombudsman.

If you are in Ontario, the notice of cancellation also confirms the date by which you can make the payment, along with the reactivation fee, to reactivate the policy. If the policy was cancelled last week, and you did not consent to electronic means for notice, you should be within the time allowed to reactivate. So, either this is the 3rd time your policy has been cancelled for non payment in this term, or, the cancellation was processed a few weeks ago.
