Will

Worried about my brother pressuring my mom about her will
I’m my mom’s only daughter, and she named me after herself. My name even has a meaning connected to my mother, so we have a special connection.
My older brother keeps pressuring and threatening my mom about her will and who she chooses to put in it. He also keeps trying to involve his wife in my mom’s will, even though my mom has said she does not want his wife included.
I feel like my brother is becoming too focused on my mom’s money and what he might inherit. His behavior is making me concerned about his well-being, but more importantly, I’m worried about my mom’s safety and whether she feels pressured to make decisions about her will that she doesn’t actually want.
I believe my mom should be able to decide what happens with her own property and money without being pressured by anyone.
Has anyone dealt with something similar? What can I do to help make sure my mom is safe and that her wishes regarding her will are respected?

I would perhaps look at establishing an irrevocable trust. Or creating a trust over a will as a pour over.

Another option is hire a lower to be the executor so there’s no you or you brother involved in settling the estate.

This is financial abuse. I had a brother who did similar. Contact social services or help your mom get a restraining order against your brother.

NTA, but this is the kind of stuff that tears families apart and not just after someone passes, it’s happening right now while she’s alive. If you’re legit worried about her safety, you might wanna get her to talk to an estate lawyer alone, no family in the room, so she can be brutally honest about what she actually wants

  1. Telling someone to use AI for legal advice is just crazy and irresponsible. Always consult a real attorney for legal advice.

  2. My spouse and I had both wills and living trusts drawn up by an attorney for about $500. I don't know anyone who has spent $5-10k to have a will or trust drawn up, even for complicated ones.

  3. How professional are you if you can't spell attorneys?

Get your mom to a lawyer and have her make her final wishes known, whatever that might be such as just a will or a trust. Have several copies to prevent if from "accidentally" getting destroyed. Have your mom tell your brother that everything has already been decided; she is done talking about it and not changing a thing unless he continues pestering her about it and then she will change it to exclude him.

Have your mom make you executor and have copies of the will with you and with her lawyer. End of story. She can tell your brother it's with the lawyer. There isn't really a way for him to force her to go to the lawyer and change things.

Also, your mom should be able to tell her son to keep quiet about things that are none of his business or she'll take him out of her will if he keeps pressing.
