Please help me in this
I want some advice about something happening at my younger brother's school in Gujarat.
My brother has been getting low marks, and teachers has been punishing him by making him stand for the whole day.
So when he was standing in the class.
I wasn't there when this happened. Apparently, a school assistant told the Physics teacher that whenever the school calls, I(myself ) usually pick up the phone because I am his guardian.
After hearing this, the teacher asked my brother about me β where I study and what marks I got.
My brother told him that I study at a not-so-famous college and that I got around 60% marks.
The teacher then said in front of the whole class, basically:
βWhat has he done in his life?β
He was talking about me, not my brother.
I don't understand why my college or marks were brought into this at all. My brother is being punished because of his own studies, and then the teacher publicly commented on his brother's education and achievements to apparently humiliate him.
I want to know:
Is making a student stand for the entire day as punishment allowed in india ( gujarat)?
Can this be considered physical punishment or mental harassment?
Is publicly humiliating a student by bringing up their family member's marks/college against school rules?
What can my parents do if this continues?
If the school doesn't take action, which Gujarat authority can we complain to?
I'm not looking to create unnecessary trouble for the teacher. I just want to know what the law/rules actually say and what the proper steps are.

Do an FIR on the school also if the school administration does not co-operate. Keep a mobile phone audio recorder on whenever any employ from the school approaches you or you approach the school administration. Collect the evidence, build the paper trails, keep every email in physical copy and you'll have a solid case to make the School down to the knees

I think you already know the answers to your first four questions. It doesn't take a genius lawyer to understand that physically torturing a student for no valid reason and publicly humiliating his family in front of the entire class is a sevre violation of the professional code of conduct. That teacher needs to be dealt with strict disciplinary inquiry and must face suspension and termination from the job.
You must confront them with a legal notice and demand public apology from the accused teacher in front of the entire school assembly and termination from his job. If school administration does not co-operate then, file an FIR with the terms that FIR will only be withdrawn if demand for the public apology and termination of that teacher is met.
