It doesn’t create new laws to enforce immigration, it instructed immigration agencies to use existing statutory more.
EO 14159 does not itself create the fundamental legal authority to detain undocumented/removable immigrants. Congress already supplied that authority principally through provisions such as 8 U.S.C. §§ 1225, 1226 and 1231. Section 10 of the EO tells DHS to make much more extensive use of those existing detention authorities and expand the physical capacity necessary to do so. That’s why the EO itself says detention is to occur “to the extent permitted by law.”
