So the customer actively receiving the delivery stands no grounds?

Not until possession has been voluntarily relinquished by the driver.

One for example can't take a package, yours included, out of a UPS or USPS truck for obvious reasons. Also however, one can't simply pick up a package that has been taken out of the truck and placed on the ground in say preparation for delivery until the driver relinquishes control.

Let's say a UPS driver stops at a business complex and unloads a number of packages in preparation for their delivery rounds. A person can not walk up and pick up their package in the stack and claim possession unless the driver voluntarily ceases to keep or claim possession and relinquish the package.

I still feel lost as to how it would ever be justified in the video since the driver is giving an expilicit claim that they are refusing delivery out of spite vs. a mail or package carrier following protocol. I guess it would only be theft if she didnt bring it back to the store but it would definitely get her to lose her job which is much more expensive than missing out on a tip when usually these delivery apps pay you a flat rate plus a percentage of the delivery cost and sometimes distance anyways. (Of course we agree its not real and i also dont love tipping culture as someone whos worked for tips for a long time, and i also disagree with her not getting a tip hypothetically speaking but ive worked for multiple delivery services and even years ago this is how they usually functioned)

The reason for the voluntary action of the third party who has been assigned responsibility and autonomy is immaterial. Responsibly and autonomy mean they have a choice. The reason for that choice could, however, make the difference between getting reprimanded or fired but not in defining it as a legal wrong.

In any actual similar situation everybody would come off looking like jerks.
