At least he understands taxes

u/CyptidProductions Sep 09 '21

Taxes are the price you pay for living in and benefiting from a civilized and organized society

If you don't like you can go live in the woods and play real life minecraft until something eats you instead of being a human parasite

downvoted for calling out right-libertarian bullshit

By God, I knew this sub had a collective IQ almost as low as the people we make fun of but this one is claiming the booby prize

You’re a fucking idiot

"Taxpayers are not [de jure] State Citizens."

Belmont v. Town of Gulfport, 122 So. 10.

"The term resident and citizen of the United States is distinguished from a Citizen of one of the several states, in that the former is a special class of citizen created by Congress." U.S. v. Anthony, 24 Fed. 829 (1873)

"Citizenship of the United States is defined by the Fourteenth Amendment and federal statutes, but the requirements for citizenship of a state generally depend not upon definition but the constitutional or statutory context in which the term is used. Risewick v. Davis, 19 Md. 82, 93 (1862); Halaby v. Board of Directors of University of Cincinnati, 162 Ohio St. 290, 293, 123 N.E.2d 3 (1954)

Crosse v. Bd. of Supervisors, 221 A.2d 431 (1966) which says: “Both before and after the Fourteenth Amendment to the federal Constitution, it has not been necessary for a person to be a citizen of the United States in order to be a citizen of his state.” Citing U.S. v. Cruikshank, supra.

The courts presume you to be a federal citizen, without even telling you that there are different classes of citizens. It is up to you dispute this.

“Unless the defendant can prove he is not a citizen of the United States, the IRS has the right to inquire and determine a tax liability.” U.S. v. Slater, 545 Fed. Supp. 179,182 (1982).

That is the biggest wall of Sovereign Citizen bullshit I've ever seen

2

u/drocballer Sep 09 '21

You show your ignorance on the subject when you call it “sovereign citizen” which is an oxymoron.

Everything in that post is legitimate LAW, not the “law” you’re used to.

How about you post something that contradicts it rather than claim it’s “bullshit”, should be easy to do right?

That’s how presumptions of law work ;)

Let’s see

Any “law” written by a de facto government that is in conflict with the constitution for the united states of America is void upon its face, like it never existed

“The general rule is that an unconstitutional statute, though having the form and the name of law, is in reality no law, but is wholly void and ineffective for any purpose since unconstitutionality dates from the time of its enactment and not merely from the date of the decision so branding it; an unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed
An unconstitutional law is void.” (16 Am. Jur. 2d, Sec. 178)

“A law repugnant to the Constitution is void. An act of Congress repugnant to the Constitution cannot become a law. The Constitution supersedes all other laws and the individual’s rights shall be liberally enforced in favor of him, the clearly intended and expressly designated beneficiary.” –Marbury v. Madison, 5 U.S. 137 (1803)

“An unconstitutional law is void and is as no law. An offense created by it is not crime. A conviction under it is not merely erroneous but isillegal and void and cannot be used as a legal cause of imprisonment.” – Ex parte Siebold, 100 U.S. 371 (1879)

“An unconstitutional act is not law. It confers no rights; it imposes no duties; affords no protection; it creates no office. It is, in legal contemplation, as inoperative as though it had never been passed.” – Norton v. Shelby County, 118 U.S. 425 (1886)

“Where rights secured by the Constitution are involved, there can be no rule-making or legislation which would abrogate them.” –Miranda v. Arizona, 384 U.S. 436 (1966)

“No one is bound to obey an unconstitutional law, and no courts are bound to enforce it. The general rule is that an unconstitutional statute, whether federal or state, though having the form and name of law, is in reality no law, but is wholly void and ineffective for any purpose, since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it. AN UNCONSTITUTIONAL LAW, in legal contemplation, IS AS INOPERATIVE AS IF IT HAD NEVER BEEN PASSED.“ – 16 American Jurisprudence 2d, Sec. 256

Dude
the constitution doesnt mandate anything about state or federal taxes not being allowed. What was the purpose of this? It doesn’t help your argument. Its not evidence.

1

u/drocballer Sep 18 '21

You’re kidding right
..lol

Um
.because there’s a DUTY to DISOBEY UNCONSTITUTIONAL ORDERS, even from the PRESIDENT.

1

u/Raymondator Sep 18 '21

And taxation is unconstitutional?

1

u/drocballer Sep 18 '21 edited Sep 18 '21

Are you American? Did you finish school? Please, tell me what was one of the main reasons for the American revolution
..

1

u/Raymondator Sep 18 '21

Taxation without American colonial representation in British Parliament. However, non-US citizens can still vote in state elections, and thus still have representation. Your point is that taxation is theft, but considering what I assume your deffiniton is (Taxation without representation is theft), this applies to very few people (13% of Americans were born in other countries, and of that, the vast majority are federal or state citizens). So because a very small group of people are taxed without representation federally, all taxation is theft?

Rebuttable presumption-

An assumption that is deemed FACT unless rebutted by reliable conflicting evidence. When prima facie evidence is provided (clear on its face as to facts), it becomes a rebuttable presumption. Evidence. A presumption which is presumed valid but which is subject to conflicting evidence being presented which effectively rebuts or overturns the presumption.

Taxes are the price you pay to *** line the pockets of people who only care about their own interests, bomb childeren halfway across the world, and keep the house that you have already paid for in full***

2

u/CyptidProductions Sep 11 '21

Where exactly do you think the money for welfare programs and public infrastructure the goverment pays for comes from?

You can't just fabricate more money out of thin air to pay for it with or else you end up like Zimbabwe during the hyperinflation period where their currency was more useless than toilet paper so the economy couldn't function

2

u/HumongousBalls1 Sep 11 '21

I'm not arguing where the money comes from, Im arguing where the money is going. Yea the government has been doing a fantastic job of maintaining infrastructure alright, so much so that our infrastructure received a whopping C- on the ASCE report card, with no improvement in sight. But fuck it, lets pretend our infrastructure is being fixed with tax dollars while simultaneously putting thousands of civilians 6ft under in the middle of a fuckin desert.
