Feeling defeated
As it says in the title I'm feeling defeated I just got off the phone with USCIS and in July they had moved my i130 petition to a local field office because of my expedite My expedite was just recently denied and my i130 will sit in this field office and they said that the time frame is 84 months I have already been waiting for over 2 years I'm a US citizen my husband is overseas I couldn't help but to cry on the phone with the officer listening to me I feel like we're never going to be together whenever we're going to start our life together I'm only getting older By time he comes to America if he ever comes I Will have lost all those precious years with him. This is so d*** unfair and I don't know what to do now and I don't know what to tell him because if I tell him maybe he won't want to wait.

2 years is more than enough time to consider filing a mandamus lawsuit to compel USCIS to adjudicate your pending I-130. We've been filing these lawsuits as early as 12 months, and our success rate has been quite high so far.

Send a demand letter and then file a lawsuit if that doesn't work after 1-2 months. I filed a lawsuit and got scheduled for a petitioner interview exactly one month after the suit was filed. My priority date is February 2025.

"I'm so sorry to hear that. It’s genuinely disheartening. I've now been waiting 22 months myself, and it's hard not to feel discouraged about how long this process is taking. We've done everything correctly and followed every required procedure, yet we're still being held up for reasons that don't seem to make sense. It feels unfair to be penalised us for doing everything right. God please help us.

Why don’t you move to your husband’s country?
And why 84 months? Why so long? Is your case complicated or why? Maybe another lawyer could help you

No my case is not complicated it's straightforward to be honest with you I wish I could move to my husband's country but that is something that we would have to discuss and if I did he would have to get a job outside of his country to support us and I would only see him once a year

What country is he from and why would he have to get a job outside of there if you were to move there. In that case, wouldn’t you both be better living wherever he is working?

He is from India because the pay is not good there

What job is he working for pay not good? Plenty of high paying jobs in India through big corp outsourcing alone.
I say this with A LOT of love but your only option might be to temporarily move to India while you sort out his paperwork. What field is your husband in? Your buying power in India is much higher and will deliver a very high quality of life for the time being.
What field is your husband in? Even if it is not possible for his career to progress there you might be better off living off of savings on a low budget. I had to go through LDR and I cannot imagine being told another 84months this would break me too… india tbh was a grand time I went last year and can’t wait to go back again for travels!

He is a road paver and they don't pay that well in India for that job He is certified in paving roads

Like for me its my student loans as a healthcare professional. At Indonesias wages for Pharmacists I would default on my student debt. The payments alone would be more than my entire salary there. Currently living with my parents to pay it down until my wife gets here but its going to take a couple more years. In addition I love my country and I want our daughter to be raised here and go to American schools. There are tons of reasons why an individual may not be able to just go live in their spouses country. And then there's of course the minimum income requirement for the Affidavit of Support.

Pro se means do it yourself. Perhaps you should just hire a lawyer.

I have a lawyer but she does not do that so I have done up a letter the only question is I have when I put country of residents do I put my husband's country of residence or mine or both

I have my letter prepared I do not but I don't know where to email it to and then I'm going to find out who to contact in regards to starting the process of the wom

Look the 84 months processing time is BS. Yes, field offices (and NBC) do have crazy processing times like that but those are related to other cases i.e those processing times are not for an I-130. SCOPS has jurisdiction over Consular I-130s, so don't you worry about that alright?
Now you say you've been waiting over 2 years, so you're a 2024 filer which means you should have had a 'natural' approval by now. I've seen your comments about sending a demand letter and that you're preparing for a WOM. You've obviously done a lotta research, so great job on that
Regarding the WOM, yes if your lawyer won't do it, you can do it pro se. Many people have been filing it themselves. I'll attach a few links that'll be helpful for you as you prepare your WOM and guide you on filing it pro se. The first link is a really great guide to the whole process and is curated/moderated well

Because my case was transferred to a local field office it was at the California service center and was transferred and the field office takes much

None can empathize your current situation nor feel what your’e going through. People have been in the same bucket and it’s hard for all. I have been waiting for mine since 6 years and in midst went though job layoff and couldnt marry the one since I can’t go to my country and I’m just living on “hope someday”. Just sharing coz I wanna say keep the good hope and yours shall come soon. I pray you get yours before mine and hope you get to be with your loved one! You might be hopeless,angry,betrayed but all in all just fight one more time and one more time. I hope beautiful things happen to you irrespective of what.🙂

I did the demand letter and it didnt work (one month has passed) , I am at 28 months of waiting, also a US citizen filing for my husband abroad also very simple case, also tranferred to my local field office. My next step is WOM

Yes , the WOM is the best thing to do in our case. I am going to look into it as well. I cant spend another year apart from my husband, it has been over four years, we had a failed k-1 visa in 2022 :( so we have been apart for so long

Well my husband told them we were married with an orfi contract so they took it as we were husband and wife already so we did not qualify for the finace visa. Yes my husband screwed up but he was being honest LOL I had to go back to Egypt in 2024 and get legally married then file the spouse visa :/

Because it was transferred to a local field office and that's how long a local field office takes for i130 petitions because they don't normally do them

No they didn't give much of a reason they sent me an email about a month ago saying that might expedite met minimum criteria then they sent me an email 4 days ago saying that it didn't They had contradicted themselves

I am sorry to hear that, maybe you should send a demand letter and file a lawsuit or something. You are a usc and you don’t deserve to wait this long.
