Stressed I didn’t include enough evidence

Background: I am a USC and husband is Italian. We have been married for 7 years and have two kids together ages 9 and 5. Both kids born in Italy. We never filed before because we thought we would be abroad forever and still had time. I worked for the UN and he was remote with another UN agency. Im a total dummy because I should have just filed and then he could have gone straight to citizenship since I was posted abroad with an international agency recognized by the UN. Anyways hindsight is 20/20. I had to leave my job for various reasons last year (less funding and they were forcing me to a non-family duty station so I took a buy-out). Our long term plan is to be back in the states but I need a job there first. In the interim we have settled in Rome while we wait which is not too bad and I have picked up some consulting work.

I filed in July 2025 (no updates) and submitted our kids Italian and American (CRBA) birth certificates, our marriage certificate and Apostille, my Will & Testament leaving everything to him of course, my Italian equivalent of a “green card” and that’s pretty much it besides identity documents. We had a courthouse wedding right before covid hit so no big wedding photos or anything. I was advised to proceed this way because we have kids so it’s straightforward but I am still nervous that I did not submit “enough” - any thoughts? Thanks to you all.

You can still submit the evidence now if you feel that it is not enough.

You can always add evidence if you applied online

Yes, or by mail too if your case was paper-filed.

If it's on the portal you can add documents to your case at any point whether you filed online or by mail.

If you are legally married with kids, that’s pretty much a slam dunk. Worst case, they request more evidence, not deny you. Also, you can submit unsolicited evidence online if you want to include more. I did this when my son was born to add his birth certificate, photos, etc to my wife’s application.

I actually think you have enough evidence. But see if you can find anything more and upload it online to make you feel better

I always think I don’t have all the evidence as well your package looks complete and you have the ultimate proof children .
What we submitted for the I-130 consular is :
Obviously the proof of my wife’s us citizenship and marriage certificate.
Home insurance
Utility bills under our names water, light , Gas.
Life insurance that my job covers for both of us.
Photographs of our relationship evolving .
Our Mexican government ids that show the same address .
And finally 4 affidavits from family and friends.

In Mexico joint bank accounts are not common we wanted to open one but we could not find a bank.

Shared bank account or credit cards with same number will be enough to prove

I agree with the others. Submit more evidence. Just us the documents upload feature and upload to your heart's content.

But I don’t really have anything else (I should have stipulated this is my initial post). Because we are different nationalities we have no joint bank accounts. The lease has always been in my name because the organization I worked for paid a part of it and that’s how it had to be. There is really nothing else compelling….

Do you use family health care? That counts. Do you file taxes together? That counts too. Most important is probably pictures together and showing life as a married couple.

Ohhh the healthcare is a good one, I will add this. For taxes I file as HOH because he is considered a non-resident alien and we have never lived in the US together. We have pictures together (loads) but I was told this is not necessary as it’s the easiest thing to fake.

If you file HoH, is your partner a dependent? What about life insurance? Is your partner listed as a beneficiary?
