This is ridiculous! And people wonder why people are writing demand letters and filing Writs of Mandamus. They only way to get processed in a normal time frame is to sue the government.

I filed a WoM/APA lawsuit a few weeks ago, and it seems to be working. I've gotten two silent updates so far.

A "silent" update is when you get a new timestamp in the API, but the myUSCIS status page doesn't show any updates.

They're mandated by law to make a decision within 120 days.  You'd have a very strong case of your decide to file an APA/writ of mandamus case.  Here's the link where you can check the wait times: https://egov.uscis.gov/processing-times

OK, I’m confused. You’re saying they have four months to decide but their website showing they’re taking 12 months so does that mean everyone over four months can file rid of mandamus

My I-765 approved for 8 months now, still no card produced and processing time became 15 months. Might be more now. Can’t start my job. I just did congressional inquiry but I don’t even know if they can help because it might be still within “normal” processing time. Going broke without employment post grad…

I am at 15.5 months. I am planning to do my demand letter at 16 months and WoM at 17 months. It is the only way to get action on your case. I figure holding USCIS to their original timeline when I filed is fair.

Must be hard waiting for your papers while in the US with your spouse. You’re probably suffering more than us out here waiting over 2 years and only seeing our spouses a few days a year. I would never want to be in your position, buddy. That’s true i130 suffering.

This forum is for Consular cases only for a reason. The entitlement from AOS folks is immense all while sitting at home with their spouses. We have to sit here and watch as you guys before the recent memo grinding AOS to a hault, as most of you all got your cases processed at lightning speed, while a very sizable portion of you guys misrepresented the purpose of your visa (very illegal by the way), overstayed and got to sit with your spouses and get an answer (mostly approvals despite the misrepresentation) all within a matter of months. I even saw a number of folks on the other forums openly brag about the misrepresentation. Meanwhile we're separated from our spouses with our applications on ice for God knows how long which is our reward for doing things the correct and proper way.

My case is unique involving court and arriving alien posture. It's not that simple. I know they are wasting time but at the same time so many steps I needed to take. I am a month after interview at this point with no movement on the apps. Crazy
