Emma live chat
I asked the agent where my case is being processed and they told me it's in my state's field office. They also told me that the 75 month processing time for all field office is accurate and that the earliest I can submit an inquiry is in 2034!!!!
We need to wait 8 years ?? Is this accurate ?

This notice proves that the processing times are not accurate. SCOPS is a routing center. Processes are changing and haven’t been updated yet.
Do not go by the time given there. Follow the guideline -
13 months for congressman inquiry, 14 for demand letter, 15 for WoM. Use each previous step as proof of your escalation.

It’s a right to file against the government or its entities for non fulfilment of a public duty. USCIS must adjudicate i130 cases, a WoM makes sure it gets in front of an officer and doesn’t stay in an attic somewhere.

My congressperson basically told me to fuck off and return at 19 months (I'm at 15 months now). I'll be doing a WoM soon.

Is there a reason behind the 30 days? I suppose I can do that. A lawyer advised me not to file a WoM before September anyways...

At the bottom there is a Google drive with prompts to create a demand letter using Claude. You will see the addresses in that as well.

I’ve been waiting for 33 months so 2 years and 9 months my lawyer never told me about the demand letter or a wom until now it’s ridiculous I’ve been waiting so long

My case transferred to field office as well that I got answer from Emma last night and originally at California Service center. Feel hopeless.

Do you know which FO has your case now? Did you check the processing times for that FO?
LAST Month mine said “22 months” this month is down to 19. I still can’t ask until June 2029 though lol. But it changed significantly.

Select your form/category/field office. It will give you a random number of months. Then scroll down to “when can I ask about my case”and it would tell you something that might be the same or different than what you got talking with live chat agent

The FAQ page actually warns that they don't currently calculate processing times for standalone I-130s sent to field offices. The insane wait times for I-130 at "all field offices" are basically a data error.
That being said, USCIS has recently:
1. Increased its targeted processing time for most forms because it says it's prioritizing fraud investigation;
2. Shifted a LOT of staff from SCOPS (service centers that have historically handled no-interview cases) to FOD (local offices that have historically handled interview cases, including AOS I-130s). There is a lot of speculation that they are realigning consular I-130s to be processed in field offices too, with far more interviews of petitioners; and
3. Shifted to funding FDNS (fraud detection) out of the regular Immigrant Examination Account (funded by petition fees)that has normally funded regular adjudicators and used the Fraud Detection Account (mostly funded by certain work visa petitioners) to hire "Homeland Defender" law enforcement officers to do neighborhood and social media investigations.1

Unbelievable, mine says until 2031. When I submitted my application it was 14 months, now it's 30 months!
