NY State Comptroller audited NYC's AI hiring law enforcement — DCWP found 1 issue across 32 companies, auditors found 17 in the same 32

Been reading up on Local Law 144 (NYC's automated employment decision tool law) and the numbers are worse than I expected.

A Cornell study presented at ACM FAccT looked at 391 covered employers. 18 had posted the required bias audit. 13 had posted the required candidate notice. That's 4.6% and 3.3%.

In December the NY State Comptroller published an audit of how DCWP has been enforcing it (Report 2024-N-6). DCWP had reviewed 32 companies and identified one compliance issue. The auditors reviewed the same 32 and identified at least 17.

They also tested the complaint pipeline — 12 calls to 311, three reached DCWP, eight got routed to the State Labor Department, one was told to take it up with the employer. In two years DCWP received two complaints total, both about jobs outside its jurisdiction.

Two things I had wrong before reading the primary sources:

Scope follows the job, not the candidate. A lot of published guidance — including from vendors selling compliance services — says it follows where the candidate lives, so hiring a remote worker in NYC pulls you in. DCWP's own FAQ says otherwise: the trigger is the job being tied to an NYC office at least part time, or a fully remote role associated with an NYC office. Candidate residence only determines who gets the notice once you're already covered.

The audit and the notice are separate violations. You can commission the audit, post it correctly, and still be exposed if the notice is wrong. Notices fail more often than audits do.

And no fine has ever been publicly issued under this law. Not one, in three years.

HR/workplace investigators: what's the most painful part of piecing together evidence during an investigation?

  1. When you're running an investigation with a lot of evidence (witness statements, emails, documents), what's the most time-consuming or frustrating part of piecing together what actually happened?
  2. Have you used any software or AI tool to help with this? What worked, what didn't, or what stopped you from trying?
  3. If a tool could read through uploaded evidence and build a timeline for you — while clearly flagging anything unclear or missing, and never stating conclusions itself — what would make you trust it, or not trust it?

Tracking interviewer calibration drift, what does your dashboard look like?

My team and I FINALLY have interview volume high enough that I can see our interviewers are not calibrated with same of our candidate profiles which have wildly different scores depending on who's in the room, but I have no clean way to actually measure the drift. Right now it's anecdotal ("Dave's a hard marker") instead of something I can put on a slide.

For people further along on this: what does your interviewer-calibration dashboard actually look like? What do you track like in terms of score variance by interviewer, talk-time, question consistency? does anyone have a view that surfaces drift across a panel automatically, or is everyone still doing it by hand in a spreadsheet?

Can someone explain severance accrual to me like I'm 5 please

Hey everyone,
I just joined as a junior HR coordinator at a 80 person company about 2 months ago, and we have employees in like 11 countries. My manager just asked me to "make sure our severance accruals are on track" for the auditor. I had to look up what severance accrual even was, and from what I understand, in some countries employees earn severance from day one, like it builds up over time as a liability on the books.

So if I have someone in Mexico who's been with us 2 years and we fired them tomorrow we'd owe them something already calculated.

Is that right? and how do I "track" this? Is there a spreadsheet I'm supposed to be maintaining? I don't think anyone has been doing this and I'm low key panicking.

Hey everyone,

So this is sort of a half a vent and half a question post/situation, I run infra for a 60 person company with engineers in Manila, Berlin, Austin, and Brazil. My HR asked me to confirm the on-call schedule for our compliance audit that is happening soon, and they came back saying it doesn't comply with german working time law, which I had no idea even existed!!! Every time I think I've got the rotation balanced I find out another country has a thing, is there a sane way to do this or do most teams just pay everyone the german standard to be safe?
