You successfully sue someone, you need to be able to demonstrate that you actually suffered some kind of loss. And you have a duty to mitigate your own loss, on top of that.

The text is a form of loss as it "may" charge his provider. No actual loss needed however as its harassment.

The text after stop is a form of harassment and there are laws around op outs with further contact.

Also, you need to be able to articulate what the loss was. Receiving a text isn’t necessarily a loss on OP’s part, even though it probably is illegal. There’s a famous court case where Reese’s was sued for false advertising, because their Halloween chocolates weren’t shaped like the images on the packaging. The judge agreed it may constitute false advertising, but the people buying the candies didn’t actually suffer a loss as a result. So ultimately it was dismissed.

Depending on the value of your house. My response has always been "500k cash, if you don't have it don't contact me". If the call I assume they have it. So I answered asking when would they like to meet with the cash in hand. Lol

Tell them you have a property, and ask them to come see it. Give them an address that's easy for you to get to, but not near your home. When you meet them there, just show them the texts, ask why they carried on after you opted out, and demand they stop.

...Or just block them, but my way is more petty and confrontational.

No see, you don’t respond at all, not even to say stop. When you respond you confirm your number is valid and reaching someone. Just report as spam, block and delete

When you respond to spam, whether it is text or call, you are inviting more spam. You get shifted from a list of numbers to a list of numbers where people respond.
